		<description>While the budget restriction isn&#039;t appropriate to a referendum, according to the BOEE, it would be an appropriate argument in an initiative. There were two unrelated initiatives that were killed on that basis in the past. Plus, the point can still be argued in court.

As Jackson et al appeal the anti-gay initiative to higher courts, the budget argument can be made. This referendum is effectively dead anyway.

The other anti-gay initiative will be rejected on the basis of being in the wrong format, as were two other anti-gay marirage initiatives dating back to 2004.</description>
