Well, until SCOTUS does enter this "mine field in the culture wars," individual states are going to continue doing precisely what they have been doing all along; allowing the rights of their citizens to be placed on a public ballot.

I, for one, am sick to death of that whole thing. At the rate we're rate, I'm going to be an 80 year old man before I'm finally able to legally marry. Sure, I can go to Maryland or any one of the small handful of U.S. states that currently allow equal marriage. Trouble is, I'd have to live in those states for the rest of my life to enjoy any of the status that goes with that marriage. And, realistically, why should I be forced to do that when my heterosexual counterparts don't have to?

Yes, it may take a few years for this to reach the Supreme Court, but I have no reservation in believing that it will. It has to. Because, until somebody official steps in and brings these backwards states to task for what they've done, we are NEVER going to see change.

This case will never reach SCOTUS. It takes 3-4 years for an appeal to get there, and the voters in California will almost certainly repeal prop 8 before then.

The justices do not want to enter a mine field in the culture wars. This case will be kicked out as moot the day after the 2012 election.
