This statement in is incorrect: "She was referring to the provision in the U.S. Civil Rights Act of 1964, which prohibits employment discrimination based on race, religion, national origin, sex, and other criteria but not on sexual orientation or gender identity." Title VII most certainly DOES ban discrimination based on gender identity, just not sexual orientation. Not only has this been recognized as the case by most circuits since the Price Waterhouse decision decades ago, but the EEOC issued a formal opinion last year explicitly confirming that gender identity is covered by Title VII.

A great deal of nastiness has resulted from misinterpretation of those passages from Leviticus, which actually refer only to a man (an "ish") having sex with a temple prostitute (a "zakhar"), not any random man. From most English translations, including the Douai and the KVJ, you would never guess that the second words translated as "man" from the Hebrew text was never intended to refer to all men; only those employed in the worship of Baal by anal coupling with the "worshippers."

While I sympathize with him and feel he was subjected to a hostile work environment, we must remember that sexual orientation discrimination is not prohibited by statute. LOC prohibitions against sexual orientation discrimination do not carry the weight of statute. Did he contest his firing to the Merit Systems Protection Board (assuming his appointment authority granted him the right to do so), based on constructive termination not directly linked to poor performance as set out by his performance standards?
