I'm not an immigration attorney, and my information is certain , it happened that I got to talk with the first couple that managed to keep the foreign partner in the US with the help Lavi Solaway http://www.stopthedeportations.com/blog/ . Ask Solaway for further details. Sorry to be the one pointing out the ugly side of this, but it's the really that many people should be aware of.

Would having an open relationship count as "marital" relationships with other people? Is this the same standard used for other-sex couples?

These are good new, however, I think It's important to mention that the foreign partner will not earn any type of permit to be Independent that means no social security number, no work permit, no driver's license. If you need to leave the US to see your family in your hometown , the chances are you will not be allowed to reenter into the US again.
