Utah marriage ban goes to court

SALT LAKE CITY — Three couples filed suit in U.S. District Court, Monday, challenging Utah’s voter approved constitutional prohibition on same-sex nuptials.

The groups bringing the suit, which alleges the law violates the U.S. Constitution, include two same-sex couples who have been barred from marrying, as well as one couple whose Iowa marriage is not recognized by the state of Utah.

“As attorney general, I swore an oath to defend the Utah Constitution and will do so by defending against this lawsuit with every resource at my disposal,” said Utah A.G. John Swallow, according to the Daily Herald.

    We are going to see more of these. The legal research is practically done with all those briefs filed for Hollingsworth. It will cost far less to launch a successful challenge from now on.
