<p>Congress could be poised to pass several pro-LGBT bills in the months that remain in this year’s legislative calendar, although Capitol Hill observers say the schedule for when the bills would see votes remains unclear.</p>
<p>   In the wake of successful votes late last month to repeal “Don’t Ask, Don’t Tell,” Congress could see momentum to pass other major legislation, such as the Domestic Partnership Benefits &#038; Obligations Act and the Employment Non-Discrimination Act.</p>
<p>   Rep. Tammy Baldwin (D-Wis.) said in an interview with the Blade this week that she had renewed optimism about the domestic partner benefits bill, which she sponsors in the House.</p>
<p>   “One issue that got renewed momentum over this Memorial Day recess was my bill to provide domestic partnership and obligations to federal employees and their partners,” she said.</p>
<p>   Baldwin, the only out lesbian in Congress, said the issue received additional attention last week when President Obama enacted limited partner benefits for federal employees through administrative action.</p>
<p>   “At the same time as he signed this presidential memorandum, he called on the Congress to send [my bill] to his desk because he can’t provide some of these very important benefits like health insurance and certain pension benefits without our passing legislation,” Baldwin said.</p>
<p>   In a statement commending Obama for issuing the benefits, U.S. House Speaker Nancy Pelosi also spoke favorably about the Domestic Partnership Benefits &#038; Obligations Act as one way to offer additional benefits to federal workers.</p>
<p>   “Congresswoman Baldwin’s bill will continue to move forward in the House and we look forward to its progress in the Senate,” Pelosi said.</p>
<p>   The domestic partner bill had significant momentum late last year when House and Senate committees reported it to the floor in each chamber. For a time, the legislation had stalled due to cost offset questions, but congressional leaders have said they’ve since received the necessary information.</p>
<p>   Baldwin said staffers of the House and Senate leaders on the legislation met Monday to discuss the bill’s path, and lawmakers in both chambers are ready to move forward.</p>
<p>   In a statement to the Blade, Sen. Joseph Lieberman (I-Conn.), the sponsor of the bill in the Senate, said the bill would be ready for floor consideration “within weeks.” Lieberman noted this estimate was for when the bill would be ready to go to the floor, not when a vote would occur, and that Senate Majority Leader Harry Reid (D-Nev.) is “responsible for setting a timetable for consideration of legislation.”</p>
<p>   Jim Manley, a Reid spokesperson, said a vote hasn’t yet been scheduled.</p>
<p>   Baldwin said she couldn’t offer a more specific timetable for when she expects the legislation to advance.</p>
<p>   “A lot happened over the course of this recess in terms of adding momentum for the legislation,” she said. “Because it happened over the recess, and I’ve been in Wisconsin, and not in Washington, and not able to have conversations with my leadership and with the other players in this, I can’t tell you if there’s a timetable yet.”</p>
<p>   Allison Herwitt, legislative director for the Human Rights Campaign, also said she doesn’t know when Congress would bring the measure to the floor for consideration.</p>
<p>   “Again, the question is how to move forward and what’s the timeframe for moving it forward, so we continue, as we have been for the past year, advocating to get this bill done,” she said.</p>
<p><strong>   ENDA faces obstacles</strong></p>
<p>   LGBT rights supporters have also strongly pushed for Congress to take up ENDA, which would bar employment discrimination against LGBT people in most public and private workplace settings.</p>
<p>   The legislation remains pending in House and Senate committees. Capitol Hill observers have said ENDA supporters lack the 60 votes to overcome a filibuster in the Senate.</p>
<p>   Still, supporters have expressed optimism about moving forward with the bill in the House. Baldwin said the LGBT Equality Caucus has been “counting the votes” and asking lawmakers how they would vote on the legislation or a harmful motion to recommit on the measure.</p>
<p>   “It’s looking strong,” Baldwin said. “I’m hopeful that we can see committee consideration and floor passage very shortly.”</p>
<p>   Rep. Barney Frank, who’s sponsoring the bill in the House, has told media outlets that a vote could take place this month or next.</p>
<p>   But a more specific time for when Congress might take up ENDA is unclear. Aaron Albright, a spokesperson for the Education &#038; Labor Committee, said he didn’t have an update or estimate on the schedule for committee action on the legislation.</p>
<p>   Baldwin said her “crystal ball has been very unclear” for ENDA consideration and that she couldn’t offer a more definite timeframe.</p>
<p>   “I was hoping it would be some months ago, but we continue to go through the vote counts, try to make sure they’re as solid as possible,” she said.</p>
<p>   Herwitt was similarly unsure about when ENDA would come to the House floor, although she said HRC was pushing for it to come before lawmakers.</p>
<p>   “Obviously, HRC wants a committee markup and a floor vote as soon as possible,” she said. “We would like to continue the momentum on moving LGBT equality forward and we would like a House vote as soon as possible.”</p>
<p>   One danger for ENDA in the House is a legislative maneuver known as the motion to recommit, which could derail the legislation once it comes to the floor. A successful vote on the maneuver on the floor would enable opponents to send the motion back to committee.</p>
<p>   Supporters have said opponents could target the bill’s gender identity provisions in the motion to recommit, although what’s targeted wouldn’t necessarily be such language.</p>
<p>   Baldwin said “there are a lot of meddlesome things” that ENDA’s opponents can do through a motion to recommit when the bill comes to the floor.</p>
<p>   “So we have been really trying to ask colleagues how they would vote in a wide variety of scenarios, so that we can feel confident that we have the votes to defeat such a motion to recommit,” she said.</p>
<p>   Herwitt noted there’s “still some concern” and “vote counting” happening around the motion to recommit.</p>
<p>   “We remain concerned to the extent that we want to continue working with leadership to shore up the votes that we need, so that when the bill comes to the floor, we have the ability to beat back a motion to recommit,” Herwitt said.</p>
<p>   Herwitt said Pelosi has expressed a commitment to move ENDA to the floor, but wants to “make sure that we’re looking at angles in terms of what the motion to recommit would be, to protect the integrity of the bill.”</p>
<p>   “If she brings the bill to the floor, she doesn’t want to lose,” Herwitt said. “So, she’s an expert vote-counter. She was a whip for many years, and so she knows what it takes to get a bill to the floor. From everything I’ve heard from her people, she wants to get it done, but she wants to get it done right.”</p>
<p>   Another pro-LGBT bill pending before Congress is legislation that would enable same-sex bi-national couples to remain together in the U.S.</p>
<p>   Current immigration law prohibits LGBT Americans from sponsoring their foreign partners for residency in the United States. Consequently, some LGBT Americans are faced with losing their partners after visas expire, while others expatriate with their partners to other countries with more favorable immigration laws.</p>
<p>   Standalone legislation known as the Uniting American Families Act would rectify this situation. But supporters of the measure see its inclusion as part of upcoming immigration reform as the optimal path for passage.</p>
<p>   Heading the legislative effort for comprehensive immigration reform in the Senate is Sen. Chuck Schumer (D-N.Y.). His office didn’t respond to a request to comment on the timing for immigration reform or whether UAFA would be included in the legislation.</p>
<p>   Still, Schumer has spoken favorably about the inclusion of UAFA in comprehensive immigration reform, and advocates are expecting him to include the provision in the bill once it’s introduced.</p>
<p>   According to the news website IrishCentral.com, Schumer said last week at a fundraising event for Irish Lobby for Immigration Reform that he thinks Congress will finish immigration reform by March 2011 — if not by the end of this year.</p>
<p>   Steve Ralls, spokesperson for Immigration Equality, said supporters of the legislation have been assured Schumer wants UAFA as part of comprehensive immigration reform.</p>
<p>   “I would even say, at this point, that the expectation is that UAFA will be part of comprehensive reform,” Ralls said. “I think Immigration Equality and other immigrant advocates fully expect it to be an inclusive bill when it’s introduced.”</p>
<p>   Still, when Schumer will introduce the legislation in the Senate remains unclear. Since the Senate Judiciary Committee would handle both immigration reform and U.S. Supreme Court nominations, many Capitol Hill observers believe the Senate will first approve the nomination of Elena Kagan to the Supreme Court before taking up the immigration issue.</p>
<p>   If Schumer includes UAFA as part of comprehensive immigration reform, the larger bill could find opposition from conservative groups that say they won’t support immigration reform with language benefitting same-sex couples.</p>
<p>   Last week, the Liberty Counsel issued a statement signed by other Christian evangelical leaders saying comprehensive immigration reform that includes UAFA would not advance in Congress.</p>
<p>   “Same-sex domestic partnerships will doom any effort for bipartisan support of immigration and will cause religious conservatives to withdraw their support,” said Mat Staver, founder and chair of the Liberty Counsel. “If same-sex domestic partnerships are included, the immigration bill will have no chance of passing.”</p>
<p>   In response, Ralls said the “cornerstone” of the U.S. immigration system has been family unification and that LGBT families “should be part of that noble commitment.”</p>
<p>   “Despite the protests of a few, many people, including many faith communities, continue to support an inclusive immigration reform bill,” Ralls said. “Methodists, Episcopalians, Jewish organizations, Unitarians and others are holding strong to a belief that a truly pro-family bill must include every family.”</p>
<p><strong>   Other bills on deck</strong></p>
<p>   Other pro-LGBT bills also could come up for consideration by the end of this year.</p>
<p>   One bill, known as the Student Non-Discrimination Act, would bar schools from discriminating against LGBT students or ignoring harassing behavior against them. Potential penalties for discrimination could include a loss of federal funding or a legal cause of action for victims.</p>
<p>   As standalone versions of the legislation remain pending in the House and Senate, supporters have said they envision passage of the bill as part of the upcoming Elementary &#038; Secondary Education Act reauthorization.</p>
<p>   Still, it’s unclear when Congress will take up this major education budget legislation. A House Democratic leadership aide noted the bill hadn’t yet been introduced, and “we can’t determine the timeline until that happens.”</p>
<p>   Should Congress begin work on the education bill, Herwitt said HRC would push for the Student Non-Discrimination Act’s inclusion as part of the larger legislation.</p>
<p>   “If the ESEA bill moves forward, you will see HRC and other groups like [the Gay, Lesbian &#038; Straight Education Network] working hard on the bill to make every effort to have it be part of the reauthorization bill,” Herwitt said.</p>
<p>   Herwitt said she’s heard conflicting stories on the education reauthorization, though, and was unsure time remains in this year’s legislative calendar to tackle the legislation.</p>
<p>   Baldwin said the Student Non-Discrimination Act’s “brightest prospect” is inclusion as part of this larger legislation, but she noted if the process stalls, congressional hearings would help educate members of Congress on the importance of the issue.</p>
<p>   “One of the things I would really hope for is hearings on that legislation to really educate members and the public on what a significant issue this is,” she said. “I think many are unaware, and I think you could build some real momentum for passage of the legislation if it were highlighted in that way.”</p>
<p>   Also of interest to LGBT rights supporters is passage of the fiscal years 2010 and 2011 foreign affairs reauthorization legislation.</p>
<p>   Last year, the House approved a version of the State Department budget legislation that would call for greater U.S. action against LGBT abuses abroad. In the Senate, legislation with identical language has been reported out of committee, but hasn’t yet reached the floor.</p>
<p>   The language urges the State Department to task more officers in the Human Rights Bureau to track violence overseas related to sexual orientation and laws criminalizing homosexuality.</p>
<p>   Additionally, the provision calls on U.S. embassies to work to reform or repeal laws overseas criminalizing homosexuality and directs the State Department to strengthen its annual human rights report with regard to reporting on abuses against LGBT people.</p>
<p>   But whether Congress will manage to pass the reauthorization bill for the State Department remains in question. The last time this legislation made its way to president’s desk was in 2002, and Manley said nothing has been scheduled for when the bill would come to the Senate floor.</p>
<p>   Mark Bromley, chair of the Council for Global Equality, was skeptical that the full Senate would find time soon to take up the measure.</p>
<p>   “I haven’t heard anything about them being able to find floor time for it,” he said. “It doesn’t seem like there’s any momentum in terms of getting it to the floor in the short term.”</p>
<p>   Herwitt noted that passage of foreign affairs authorization has often been a difficult task for Congress.</p>
<p>   “There have been many years when the State Department authorization bill never made it to the floor just because it becomes a heavy legislative lift — not because of our issues, but because of the bigger issues that are in the bill,” she said.</p>
<p>   Baldwin said she was nonetheless optimistic about the bill’s chances this year because both chambers of Congress have moved forward on it.</p>
<p>   “I would be hopeful — given that there’s interest now in both houses of Congress — that we can see it through,” she said.</p>

<p>As activists and lobbyists continue to press for repeal of “Don’t Ask, Don’t Tell,” some are losing patience with President Obama and moderate Democrats in Congress.</p>
<p>Obama was heckled at a fundraiser on Monday and a group of six former LGBT service members chained themselves to the White House fence this week to protest what they view as slow progress in overturning the law.</p>
<p>Meanwhile, the Human Rights Campaign and other advocates are working to push six key senators to support repeal of “Don’t Ask, Don’t Tell” this year.</p>
<p>Moderate senators from six states — Florida, Indiana, Massachusetts, Nebraska, Virginia and West Virginia — are the targets of HRC’s grassroots campaign. The renewed push to win their support comes as the Senate Armed Services Committee is poised to tackle the issue May 26 when it takes up the Defense authorization bill.</p>
<p>Allison Herwitt, HRC’s legislative director, said the grassroots effort is being coordinated by about two dozen field workers and includes postcards, phone calls, district office visits, op-ed placements and other media coverage.</p>
<p>“We’re also, where we can, working with some grasstops folks to weigh in with senators, and it’s an ongoing process,” she said.</p>
<p>Marty Rouse, HRC’s national field director, said the campaign builds on the organization’s earlier efforts such as the Voices of Honor tour and involves “identifying and mobilizing veterans” to contact senators and participate in the joint Lobby Day between HRC and Servicemembers United on May 11.</p>
<p>Servicemembers United Executive Director Alex Nicholson said his organization is identifying veterans with HRC’s membership and bringing in new veterans not connected to any organization to advocate for repeal.</p>
<p>“We’re basically setting up a number of events in each of these states with vets to talk about ‘Don’t Ask, Don’t Tell’ to get the issue to the local media,” he said.</p>
<p>But even with this campaign underway, senators from these six states aren’t yet committed to voting for repeal. Many are saying they want to hear the results of the Pentagon study on “Don’t Ask, Don’t Tell,” which is due Dec. 1, before taking action. The mandate of the study, as established by Defense Secretary Robert Gates and Chairman of the Joint Chiefs of Staff Adm. Mike Mullen, is to examine how the U.S. armed services would implement open service should Congress repeal the ban.</p>
<p>One such senator waiting for the study results is Jim Webb (D-Va.). Asked by DC Agenda on Tuesday whether he favors repeal, Webb emphasized his support for the review currently underway.</p>
<p>“I think what Secretary Gates and Adm. Mullen proposed in terms of the study is very important,” Webb said. “We need to understand that. I support the approach that they’re taking. It’s responsible.”</p>
<p>Pressed on how he would vote on an amendment during the defense authorization markup, Webb reiterated his support for the working group and replied, “I think we need to honor the process that Secretary Gates and Adm. Mullen have put in motion.”</p>
<p>Holding a similar position is Sen. Bill Nelson (D-Fla.). In a statement, Nelson spokesperson Grant Schnell said the senator is interested in the results of the study.</p>
<p>“Sen. Nelson’s inclined to support repeal of the “Don’t Ask, Don’t Tell” policy, but wants to see the study Secretary Gates announced of how this would impact the military,” Schnell said.</p>
<p>Also refraining from endorsing repeal was Sen. Evan Bayh (D-Ind.). In a statement, Bayh said he’s “committed to ensuring that our troops are treated with the respect they have earned through their selfless service” and that his personal belief is “those who are willing to take a bullet for their country ought to be able to serve it openly.”</p>
<p>“However, President Obama is absolutely right to solicit the input and support of his top military commanders about the effects of repealing the ‘Don’t Ask, Don’t Tell’ policy,” Bayh said. “I will make a final decision after receiving the input of our top commanders.”</p>
<p>The offices of Sens. Robert Byrd (D-W.V.), Scott Brown (R-Mass.) and Ben Nelson (D-Neb.) didn’t respond to DC Agenda’s request for comment.</p>
<p>Asked about the progress in moving these senators to support repeal, Herwitt said the campaign is “a work in progress” and that many lawmakers typically hold out on announcing support for pro-LGBT legislation until just before it comes to a vote.</p>
<p>“You always have that last handful of House members or senators that you’re really looking to secure support from, and they’re typically the ones that don’t declare early,” she said.</p>
<p>Rouse noted that there’s a “significant presence” of mobilized efforts to repeal “Don’t Ask, Don’t Tell” in the six states where HRC is working to influence senators.</p>
<p>“If you talk [with] any leaders or politically engaged people in these six states, I think they would acknowledge that there has been significant movement across the states in support of ending ‘Don’t Ask, Don’t Tell,’” Rouse said.</p>
<p>Nicholson also said “it’s really too early” to tell whether the effort will be successful in moving moderate senators to vote for repeal.</p>
<p>“With these swing vote senators, they’re not going to make up their minds until the last minute, and [then only if they] absolutely have to,” he said. “If they’re not forced to take the vote, I don’t think they’re going to take the risk of coming out one way or the other.”</p>
<p>Still, Nicholson said he’s seen evidence of these senators noticing the campaign’s efforts in their states, citing Nebraska as an example where increased media coverage of “Don’t Ask, Don’t Tell” has come to the attention of Ben Nelson’s staff.</p>
<p>Nicholson said he’s heard members of Ben Nelson’s staff have taken the initiative in conversations with other staff members on Capitol Hill to mention an uptick in newspaper stories coming from Omaha, Neb., and Lincoln, Neb., on “Don’t Ask, Don’t Tell.”</p>
<p>“What we do know right now, what we are able to see, is that it’s being noticed — that’s for sure,” Nicholson said.</p>
<p><strong> ‘Within a vote or two’</strong></p>
<p>But with votes from these key senators still in play, it remains to be seen whether there will be sufficient votes in the Senate Armed Services Committee to advance repeal.</p>
<p>During a press event Tuesday, Sen. Mark Udall (D-Colo.), a strong proponent of repeal in the Senate, was optimistic about having enough support, noting that “we’re very close” and “we’re within a vote or two.”</p>
<p>“There are certainly a number of senators on [the Democratic] side that are on record as wanting to overturn ‘Don’t Ask, Don’t Tell,’ and there are some who have not made their intentions clear,” Udall said.</p>
<p>Among Republicans, Udall said Sen. Susan Collins (R-Maine), a moderate who often supports LGBT civil rights bills, has “expressed an interest in overturning ‘Don’t Ask, Don’t Tell.’”</p>
<p>Nicholson estimated that a vote now in the Senate Armed Services Committee to repeal “Don’t Ask, Don’t Tell” would have a 25 to 50 percent chance of succeeding without further intervention from the administration.</p>
<p>“I think that Bayh and Bill Nelson are ‘lean yeses,’” Nicholson said. “They’re undecideds, but they’re undecideds leaning towards ‘yes.’”</p>
<p>One factor that would be seen as a tremendous boon — and perhaps even essential — to moving key senators to support repeal is an explicit endorsement from President Obama to attach an end to “Don’t Ask, Don’t Tell” to the upcoming Defense authorization bill.</p>
<p>But the White House and the Pentagon have not come forward with an explicit endorsement of repeal this year. In response to a query from DC Agenda during a press briefing last month, Gates said he doesn’t recommend a change in the law until the Defense Department completes its study implementing open service and that he thinks the president is comfortable with this process.</p>
<p>On Monday, Aubrey Sarvis, executive director of the Servicemembers Legal Defense Network, wrote a letter to Obama urging him to come out for repeal. Sarvis said he’s concerned about “multiple reports” that the president’s congressional liaison team “is urging some members of Congress to avoid a vote on repeal this year.”</p>
<p>Among those noticing a lack of support from the Obama administration to repeal “Don’t Ask, Don’t Tell” at this time is Senate Armed Services Committee Chairman Carl Levin (D-Mich.). Asked by DC Agenda on Tuesday what the White House and the Pentagon are saying they want from lawmakers on “Don’t Ask, Don’t Tell,” Levin replied, “Let them complete the analysis.”</p>
<p>During his press event, Udall called for a stronger voice from Obama. While acknowledging the president made clear in January during his State of the Union address that he wants to work to repeal “Don’t Ask, Don’t Tell,” Udall said he wants to see and hear more from Obama on the issue.</p>
<p>“The White House has, in the State of the Union address, made it clear they want to repeal ‘Don’t Ask, Don’t Tell,’” Udall said. “The timing they continue to leave up to the Congress. That’s why I think it will be very useful if the president weighed in and said that this year is the year to finish the job.”</p>
<p>Anger with Obama for failing to endorse immediate repeal led protesters to interrupt the president’s speech Monday at a Los Angeles fundraising event for Sen. Barbara Boxer (D-Calif.).</p>
<p>In another protest, six LGBT veterans handcuffed themselves to the gates of the White House on Tuesday in protest over “Don’t Ask, Don’t Tell” and were subsequently arrested. Among the demonstrators were Lt. Dan Choi and Capt. Jim Pietrangelo, who were arrested last month after handcuffing themselves to the White House fence in a similar protest.</p>
<p>In a statement, Choi said he and other LGBT veterans participated in the action out of concern that the president is wavering on his commitment to push for ending “Don’t Ask, Don’t Tell.”</p>
<p>“We are handcuffing ourselves to the White House gates once again to demand that President Obama show leadership on repealing ‘Don’t Ask, Don’t Tell,’” Choi said. “If the president were serious about keeping his promise to repeal this year, he would put the repeal language in his Defense authorization budget.”</p>
<p>Following the protest in Los Angeles, White House Deputy Press Secretary Dan Burton wouldn’t say in response to a reporter’s question aboard Air Force One whether Obama supports repeal at this time. Instead, Burton emphasized that “a tremendous amount of progress” has been made on the issue.</p>
<p>“This is a policy that’s been in place for quite a long time, and as we’ve seen on other issues, change is hard,” he said. “But that said, what we’ve seen is the Chairman of the Joint Chiefs of Staff and the Secretary of Defense both come out in support of this change, and we’re moving with as much speed as possible to see that it’s done.”</p>
<p>Nicholson said he doesn’t think it’s possible to move senators to vote for an immediate repeal bill without more support from the president. But he noted a bill with delayed implementation, as Servicemembers United previously recommended, is possible.</p>
<p>“I think that’s the best chance we have for getting this because it’s the only thing consistent with what the Pentagon wants and it’s the only … middle ground between what the Pentagon says they want and what we are willing to give up and accept,” Nicholson said.</p>
<p>Nicholson said the repeal legislation currently before the Senate isn’t a delayed implementation bill because it calls for an immediate cessation of discharges while allowing the Pentagon working group to complete its study.</p>
<p>Regardless of the positions of the White House and Pentagon, Herwitt said HRC and other advocates are working to make repeal happen this year in the hopes of moving moderate senators to vote for repeal.</p>
<p>“I think that we are going to continue to push and advocate for these senators’ votes,” she said. “The president said in the State of the Union address that he will work with Congress this year and we are continuing to push forward.”</p>

<p>Supporters of LGBT rights are turning up the heat on Congress in their efforts to pass several key bills after lawmakers return from recess next week.</p>
<p>Allison Herwitt, legislative director for the Human Rights Campaign, alluded to potential political consequences if the bills don’t advance in this Congress.</p>
<p>“I do think that there will be many LGBT Americans frustrated and disappointed if any of these [bills] don’t move,” she said. “Even though we don’t have a pro-LGBT majority in the House and the Senate — this is our highest majority that we have and we need to obviously capitalize on the members that we have in the House and the Senate to pass legislation. So, in short, I do think that there will be anger in the community.”</p>
<p>Herwitt said this anger would likely manifest itself in LGBT voters feeling disconnected from Congress and from the Obama administration.</p>
<p>This disconnect, Herwitt said, could affect political donations or discourage people from getting involved in re-election campaigns as well as “not door knocking, literature dropping, all that kind of stuff.”</p>
<p>Herwitt also urged a stronger voice from the White House in advocating for legislation like the Employment Non-Discrimination Act and the Domestic Partner Benefits &amp; Obligations Act, as well as repeal of “Don’t Ask, Don’t Tell.”</p>
<p>“I do think that it is important that the president and the administration do strongly indicate to the House and the Senate their support and their desire to move on ENDA, ‘Don’t Ask, Don’t Tell’ and DPBO,” she said.</p>
<p>Michael Mitchell, executive director of the National Stonewall Democrats, voiced similar views.</p>
<p>“I think that we’re seeing some — donors are starting to put their money elsewhere or holding off,” he said. “I think that there are rank-and-file folks who are getting frustrated.”</p>
<p>Mitchell said he thinks “we need to remember” that Obama has been in the White House for fewer than 18 months.</p>
<p>“On the other hand, a lot of people have been working on these issues for decades, and people don’t want to wait any longer, and we’ve been laying a lot of groundwork for a very long time and we see this as our window to get this stuff through,” he said.</p>
<p>The November elections are weighing heavily on the minds of LGBT rights advocates. Mitchell said the passage of LGBT bills this Congress is important because of the strong possibility of reduced Democratic majorities.</p>
<p>“The landscape could certainly be more difficult for us, especially if it gets closer in the House,” he said. “I said recently somewhere that [you] only need to look back about 18 months or two years to see how hard it was to pass our agenda when we didn’t have control, and I think it will, again, be like that.”</p>
<p>Key pieces of pro-LGBT legislation in Congress have encountered roadblocks.</p>
<p>Advocates are urging for the inclusion of “Don’t Ask, Don’t Tell” repeal as part of the upcoming defense authorization bill, but whether the votes exist in the Senate Armed Services Committee to attach the provision to the legislation remains to be seen.</p>
<p>President Obama hasn’t spoken publicly in favor of repealing the ban since his mention of the issue in his State of the Union address, and Defense Secretary Robert Gates told reporters in response to a DC Agenda question last month that he doesn’t recommend legislative action this year before the Pentagon working group completes it study of the issue.</p>
<p>For ENDA, a House committee markup of the legislation has been pushed back since late last year and still has yet to be scheduled, although advocates are saying activity could happen in April or May. Multiple sources have told DC Agenda that the Senate lacks the 60 votes needed to overcome any attempted filibuster of ENDA.</p>
<p>Problems also plague legislation that would provide benefits to the same-sex partners of federal employees. Supporters of the bill in the Senate have said they won’t move the bill to a floor vote until the U.S. Office of Personnel Management provides information on how it will offset the bill’s costs.</p>
<p>Months have passed since House and Senate committees marked up the bills late last year and sent them to the floors of their respective chambers, but OPM hasn’t yet made the offset information public. The agency didn’t immediately respond to DC Agenda’s request for an update on the situation.</p>
<p>During a panel discussion last week on the U.S. Census, Mara Keisling, executive director of the National Center for Transgender Equality, took time from her remarks to urge advocates on Capitol Hill to redouble their efforts.</p>
<p>“The LGBT community is very, very serious about getting all these three things done and it does not yet appear that Congress is serious about it,” she said.</p>
<p>Keisling later clarified for DC Agenda that her comments were “just me saying, ‘Hey pass these things.’ It wasn’t me saying, ‘You guys aren’t passing them.’”</p>
<p>“The clock is running down, but there is still time to do it and we have to demand they do it,” she said. “It gets harder and harder for them the longer they put it off. Health care is out of the way — start getting stuff done.”</p>
<p>The window of opportunity for Congress to act on these bills before lawmakers break to run their re-election campaigns is steadily becoming smaller.</p>
<p>After lawmakers return this month, Herwitt said they’ll work through July before they break again for August recess and then do more work in September and October before leaving to focus on re-election.</p>
<p>Herwitt said she’s heard talk about a lame duck session following the November election, but said she doesn’t “know if that will play itself out or not.”</p>
<p>While concerned about the passage of these bills before the end of the year, advocates are anticipating some activity in the coming weeks when lawmakers return from spring break.</p>
<p>Herwitt said she’s expecting the House Education &amp; Labor Committee to take up ENDA and send it to the floor sometime in April or May.</p>
<p>That timetable would square with remarks Rep. Jared Polis (D-Colo.) made to Karen Ocamb, a lesbian Los Angeles-based journalist, that ENDA would pass committee by the end of April and reach the floor a week or two later.</p>
<p>Herwitt said Rep. Barney Frank (D-Mass), the House sponsor of ENDA, has said he’s ready to move forward with the legislation and to have a floor vote.</p>
<p>“This is not new — you even wrote a story about it — the Senate is much more of a challenge for us on ENDA, but I think, at least from HRC’s perspective, getting a strong vote in the House will help us push the Senate forward,” Herwitt said.</p>
<p>Regarding “Don’t Ask, Don’t Tell” repeal, advocates are working to include the language as part of the Senate version of the defense authorization bill when the Senate Armed Services Committee takes up the legislation in May.</p>
<p>“Either it’s in the chairman’s mark or we do it as an amendment, and that’s why we’re focusing very strategically in some of our key states that coincide with many of the members that sit on the Armed Services Committee,” she said.</p>
<p>In the House, Herwitt said gay rights supporters are pushing for an amendment on the floor to include “Don’t Ask, Don’t Tell” repeal as part of the defense authorization bill after the Senate committee takes it up.</p>
<p>Herwitt said advocates are looking at a floor vote in the House as opposed to a committee vote because they “are challenged” with the number of conservative Democrats on the panel and the virtually non-existent support from Republicans.</p>
<p>Supporters of repeal, Herwitt said, are “in a very good place to move forward with a vote” in the House. Rep. Patrick Murphy (D-Pa.), the sponsor of the House bill, has said he has the votes to pass repeal on the House floor.</p>
<p>“We are always, I think, in a better, or I should say, a stronger position, when both bodies act on whatever provision it is that we’re trying to move forward,” she said. “So I think that we’re in a stronger place if we have the language repealing ‘Don’t Ask, Don’t Tell’ in the Senate bill and we have a House floor vote.”</p>

<p>The announcement that Sen. Joseph Lieberman (I-Conn.) would introduce “Don’t Ask, Don’t Tell” repeal legislation next week in the U.S. Senate was hailed by many opponents of the law as an important step toward undoing the nation’s ban on service by open gays and lesbians.</p>
<p>But some are questioning the wisdom of Lieberman introducing a standalone bill when “Don’t Ask, Don’t Tell” repeal can be accomplished through other methods.</p>
<p>According to an internal memo obtained by DC Agenda, the Human Rights Campaign is taking credit for landing Lieberman as the champion for repeal in the Senate.</p>
<p>“Additionally, working with the White House and Senate leadership, HRC has secured Sen. Joe Lieberman (ID-CT) as the Senate lead sponsor — someone who not only sits on the Armed Services Committee, but also brings a centrist approach and net to this issue,” says the memo.</p>
<p>The HRC memo also addresses the strategy of winning repeal via the defense authorization bill and notes particular concern about where members of the Senate Armed Services Committee stand on the issue.</p>
<p>“Including [repeal] in the base [Department of Defense] authorization bill will require a vote in the Senate Armed Services Committee,” says the memo. “Only one Republican on the committee, Sen. Susan Collins (R-ME), is likely to support repeal. In addition, a number of key Democrats do not currently support repeal: Sens. Robert Byrd (D-WV), Bill Nelson (D-FL), Evan Bayh (D-IN), Ben Nelson (D-NE) and Jim Webb (D-VA). Securing a minimum of two of these five Democrats is essential. Nelson, Bayh and Webb are the three best prospects.”</p>
<p>The memo also says that convincing House members from New Jersey and Texas to sign on in support will be crucial for House passage of the bill.</p>
<p>Last month, a group of LGBT advocates held a secret strategy meeting related to “Don’t Ask, Don’t Tell.” A source who attended the meeting, speaking to DC Agenda on condition of anonymity, questioned why HRC pursued the Lieberman-led path for repeal when the consensus among many lobbyists is that including repeal as part of the fiscal year 2011 defense authorization bill is the best route.</p>
<p>“As for Lieberman, I would just say I applaud that he did it because there has not been a bill in the Senate and now we can start asking people to sign on and figure out where people are, but I’m not sure that it’s not just a diversion tactic to show that HRC’s done something,” the activist said.</p>
<p>In a statement, Allison Herwitt, HRC’s legislative director, said her organization has been working with Lieberman for months about introducing standalone legislation because “it’s an important educational and organizing tool.”</p>
<p>“It helps constituents lobby their senators to co-sponsor and publicly support repeal,” she said. “Introduction of a bill in no way precludes strategy involving the Defense Department Authorization bill.”</p>
<p>Kevin Nix, spokesperson for Servicemembers Legal Defense Network, said that HRC was not alone in pursuing Lieberman as lead sponsor of repeal legislation and noted that his organization has worked with the senator for some time.</p>
<p>“We’ve been working with Lieberman for, I think, years — just like HRC has been, as well,” he said.</p>
<p>Nix said despite the imminent introduction of a standalone “Don’t Ask, Don’t Tell” repeal bill, advancement of the effort as part of the upcoming defense authorization bill is “absolutely” the best way to go.</p>
<p>“Obviously, it’s historic,” he said. “We welcome all of this stuff with Lieberman, and introducing a standalone bill is hugely significant, but if we’re going to get legislative repeal this year, then the repeal language needs to be in the authorization bill, and we’ll be working with [Senate Armed Services Committee] Chairman [Carl] Levin to make sure the votes are there.”</p>
<p>In a statement, Lieberman said he’d proudly sponsor “the important effort to enable patriotic gay Americans to defend our national security and our founding values of freedom and opportunity.”</p>
<p>“To exclude one group of Americans from serving in the armed forces is contrary to our fundamental principles as outlined in the Declaration of Independence and weakens our defenses by denying our military the service of a large group of Americans who can help our cause,” he said.</p>
<p>News of Lieberman’s bill was first reported by Jamie Kirchick in the New York Daily News. Several important details about Lieberman’s upcoming legislation weren’t immediately revealed this week, though, such as whether any Republican senators have signed on as co-sponsors. It’s also unknown whether the legislation will call for the same timeline for repeal provided in the House legislation sponsored by Rep. Patrick Murphy (D-Pa.).</p>
<p>Servicemembers United, a gay veterans group, is calling for a longer implementation time that would allow 18 months for the Pentagon to first complete its expected yearlong study of implementing repeal.</p>
<p>Lane Hudson, a D.C.-based gay activist, said the “devil will be in the details” for Lieberman’s bill and that he’s hoping the senator incorporates the timeline advocated by Servicemembers United.</p>
<p>“As long as Lieberman is going to introduce viable legislation, I think he’s an excellent person to be the chief sponsor,” Hudson said. “He’s got a great relationship with the Blue Dogs in the Senate caucus, and he’s probably the best Democrat to keep [Republican U.S. Sen.] John McCain from fiercely opposing repeal.”</p>

<p>A small corps of LGBT political insiders, speaking on condition that they not be identified, believe the Employment Non-Discrimination Act is headed for almost certain defeat this year because supporters can’t line up the 60 votes in the Senate needed to overcome a filibuster.</p>
<p>Breaking what some have called an informal code of silence adopted by mainline LGBT political organizations, at least four sources familiar with the gay and transgender civil rights bill said the lack of Senate votes became clear long before Republican Scott Brown won his upset victory last week in Massachusetts.</p>
<p>“What we’re hearing is there is just no clear path to pass ENDA in the Senate,” said one activist familiar with the bill’s lobbying effort. “They don’t think they have 60 votes to pass it.”</p>
<p>Another source with ties to Capitol Hill and national LGBT political groups based in Washington was more definitive.</p>
<p>“ENDA has been off the agenda since before the Massachusetts election because they couldn’t secure the votes in the Senate,” the source told DC Agenda.</p>
<p>The bill would bar private sector employment discrimination based on an individual’s sexual orientation or gender identity.</p>
<p>Opposition to the gender identity provision, included to help protect transgender people, is among the contributing factors that’s prevented supporters from lining up the needed 60 votes to break a filibuster, one of the sources said.</p>
<p>The Human Rights Campaign, National Gay &amp; Lesbian Task Force, and National Center for Transgender Equality — three leading groups working on ENDA — say they are confident the House of Representatives will pass ENDA in the summer or early fall.</p>
<p>Officials with HRC and NCTE have said they remain hopeful that Democrats and a few moderate Republicans in the Senate will unite to defeat a filibuster and pass the long-awaited LGBT civil rights measure.</p>
<p>“I’m still optimistic,” said veteran transgender activist Mara Keisling, executive director of NCTE. “The Senate’s always been the harder challenge on every piece of legislation, not just on LGBT legislation. So the Senate’s a challenge; we’ll get there.”</p>
<p>As of this week, the bill had 194 co-sponsors in the House and 44 co-sponsors in the Senate. Only two of the Senate co-sponsors are Republicans: Sens. Susan Collins and Olympia Snowe, both from Maine.</p>
<p>When combined with its lead sponsor in the House, Rep. Barney Frank (D-Mass.), and the lead sponsor in the Senate, Sen. Jeff Merkley (D-Ore.), the measure has what most observers believe to be at least 195 certain votes in the House and 45 assumed votes in the Senate.</p>
<p>Frank and Speaker of the House Nancy Pelosi (D-Calif.), a longtime supporter of ENDA, have said they were confident that backers would line up more than the 218 House votes needed to pass the bill.</p>
<p>But in the Senate, LGBT civil rights lobbyists have been reluctant to reveal the findings of their highly confidential head counts, including leanings of the 17 Senate Democrats that have not signed on as co-sponsors. Among them are Sens. Jim Webb and Mark Warner, both of Virginia.</p>
<p>A longtime practice in Washington lobbying has been to hold off on publicly disclosing the names of lawmakers who are uncommitted or say they are leaning against a bill, with the hope that they could be persuaded to change their minds. If a lawmaker is pressured to publicly declare his or her position, the lawmaker is less likely to switch positions out of fear of being labeled a flip-flopper, according to seasoned lobbyists and members of Congress.</p>
<p>One of the sources who told DC Agenda that ENDA appears dead in the Senate said that groups like HRC, the Task Force and NCTE are diligently working behind the scenes to line up more Senate Democrats to commit to voting for cloture, the parliamentary procedure used to end a filibuster. Sixty votes are needed to invoke cloture.</p>
<p>Most political observers believe supporters have the 51 votes to pass the bill in the 100-member Senate, if a filibuster can be broken.</p>
<p>Allison Herwitt, HRC’s legislative director, was circumspect about ENDA’s prospects in the Senate in an interview earlier this month with DC Agenda.</p>
<p>“We have education that we need to do and have conversations,” she said. “I know that Sen. Merkley and his staff have been really on top of this, and having those conversations staff-to-staff — and the senator is having colleague-to-colleague conversations. And we just need to continue some of that process and then see where we are with the vote count.”</p>
<p>Asked whether the gender identity provision could be a problem in the Senate, Herwitt said, “I think what I’m saying is we’re still in the process of figuring all of that out. The conversations are still happening; the education process is still ongoing.” She added that HRC is pushing hard for a “fully inclusive bill.”</p>
<p>Spokespeople for the Task Force, National Stonewall Democrats, Lambda Legal Defense &amp; Education Fund and the ACLU’s LGBT Rights Project did not return calls this week seeking comment on the reports that ENDA backers may be unable to break a Senate filibuster.</p>
<p>Jim Manley, a spokesperson for Senate Majority Leader Harry Reid (D-Nev.), said it’s too soon for Reid to assess ENDA’s chances on the Senate floor because the bill has yet to be reported out of committee.</p>
<p>Last November, the Senate’s Health, Education, Labor &amp; Pensions Committee, chaired by Sen.  Tom Harkin (D-Iowa), an ENDA co-sponsor, held a legislative hearing on the bill. At the time of the hearing, Harkin promised to hold a markup hearing on the bill this year, but he did not set a date for the markup.</p>
<p>Markup hearings are required under both House and Senate rules for making final revisions of bills before voting in committee to send them to the floor for a vote by the full House or Senate.</p>
<p>“In the hearing, Sen. Harkin said that he wants to move the bill this year,” said Bergen Kenny, Harkin’s press secretary, in an e-mail this week to DC Agenda. She did not respond to questions about when Harkin would hold the markup or whether he was aware of reports that supporters lacked the votes to break a filibuster.</p>
<p>Julie Edwards, Merkley’s press secretary, pointed to a statement by Harkin at the legislative hearing last November that he would like to see the bill moved to the Senate floor in the spring of 2010.</p>
<p>“I would say that’s the goal,” Edwards said. “That’s what we’re working toward. We continue to reach out to other offices. I know supporters of this legislation are doing the same.”</p>
<p>Asked if Merkley believes he has 60 votes to break a filibuster, Edwards said, “We haven’t done a whip count on this. But we’re continually building support for the bill.”</p>
<p>Although many Capitol Hill observers think the House will pass ENDA sometime this year, Frank raised concerns among some activists earlier this month when he told the Advocate that lawmakers still have problems with the bill’s transgender provision.</p>
<p>“There continues to be concerns on the part of many members about the transgender issue, particularly about the question of places where people are without their clothes — showers, bathrooms, locker rooms, etc.,” the Advocate quoted him as saying.</p>
<p>“We still have this issue about what happens when people who present themselves as one sex but have the physical characteristics of the other sex, what rules govern what happens in locker rooms, showers, etc,” he said.</p>
<p>Frank was out of the country on House business this week and could not be reached. His press secretary, Harry Gural, said Frank’s comments to the Advocate should not be interpreted to mean that the congressman feels the bill is in trouble in the House.</p>
<p>“They don’t expect a holdup on this,” said Gural, who added that no one familiar with the bill believes an attempt will be made to remove the transgender provision.</p>
<p>He was referring to a blowup in 2007, when Frank and House Democratic leaders determined there weren’t enough votes in the House to pass a trans-inclusive version of ENDA. At Frank’s urging, House Democrats introduced and pushed through the full House a revised bill that didn’t include protection for transgender people. The bill died a year later when the Senate failed to act on it following an outcry by many activists urging the Senate not to pass it.</p>
<p>“Barney said that is not going to happen this time,” Gural said.</p>

<p>As lawmakers hash out the 2010 legislative schedule for Congress, LGBT rights supporters are anticipating a House markup for the long-sought Employment Non-Discrimination Act within the next month.</p>
<p>Sources familiar with Capitol Hill said the House Education &amp; Labor Committee will take up ENDA, which would bar job bias against LGBT people in the public and private workforce, shortly after lawmakers return from holiday break.</p>
<p>Last year, House and Senate committees held hearings on legislation that would provide workplace protections for LGBT people. The next step in both committees — the Education &amp; Labor Committee in the House and the Health, Education, Labor &amp; Pensions Committee in the Senate — is reporting out the legislation so floor votes can take place.</p>
<p>Rep. Jared Polis (D-Colo.), a gay lawmaker who serves on the House Education &amp; Labor Committee, said he&#8217;s expecting a markup of the legislation either this month or in February and a floor vote soon after.</p>
<p>“Once it&#8217;s been marked up in committee, it&#8217;s simply a matter of scheduling it for the floor, and that of course depends on what else is coming to the floor, whether it&#8217;s health care or what[ever] it is, but it shouldn&#8217;t take very long,” he said.</p>
<p>Also expecting an ENDA markup in the House shortly is Allison Herwitt, legislative director for the Human Rights Campaign.</p>
<p>“We&#8217;re hopeful that it will be either January or February and we&#8217;re pushing for that,” she said.</p>
<p>Still, it&#8217;s unclear exactly when the House committee will take up the legislation. Aaron Albright, spokesperson for the House &amp; Education Labor Committee, said, “nothing has been scheduled yet.”</p>
<p>Meanwhile, in the Senate, Jeff Merkley (D-Ore.), who sponsors ENDA in that chamber, has said the HELP Committee will take up ENDA in the spring, but Herwitt said the timing in the Senate “is a little less clear.”</p>
<p>“I think that we&#8217;re going to talk to [Chair Tom] Harkin&#8217;s staff people, committee staff and try to figure all of that out, what&#8217;s the timeframe that they&#8217;re looking at, how will we envision the bill moving forward in the Senate,” she said. “I mean, obviously, the Senate provides us more challenges in moving legislation, especially when it is freestanding.”</p>
<p>Advocates are committed to passing a version of ENDA that provides protections on the basis of sexual orientation and gender identity.</p>
<p>The inclusion of transgender people in ENDA has been a sensitive issue. In 2007, Rep. Barney Frank (D-Mass.) came under fire for pushing a version of ENDA that provided protections only on the basis of sexual orientation, saying at the time that Congress lacked the votes to pass an inclusive bill.</p>
<p>This year, the situation is different. Polis said lawmakers expect to pass “an inclusive ENDA that includes protections based on gender identity.”</p>
<p>Herwitt expressed similar optimism that the House would be able to pass ENDA with protections based on sexual orientation and gender identity.</p>
<p>“I think that we&#8217;re in a really strong place in the House,” she said. “I think that, again, when we look at our vote count for final passage, it looks good for a fully inclusive bill.”</p>
<p>Still, Herwitt said conversations are more nascent on the Senate side regarding ENDA and the inclusion of gender identity provisions.</p>
<p>“We have education that we need to do and have conversations,” she said. “I know that Sen. Merkley and his staff have been really on top of this, and having those conversations staff-to-staff — and the senator is having colleague-to-colleague conversations. And we just need to continue some of that process and then see where we are with the vote count.”</p>
<p>Asked whether the gender identity provisions could be a sticking point in the Senate, Herwitt replied, “I think what I&#8217;m saying is we&#8217;re still in the process of figuring all of that out. The conversations are still happening, the education process is still ongoing and obviously we want to make sure that the bill moves forward when it can move forward as a fully inclusive bill.”</p>
<p><strong>Activists want DADT repeal in budget request</strong></p>
<p>The repeal of “Don&#8217;t Ask, Don&#8217;t Tell,” the 1993 law that prohibits openly gay people from serving in the U.S. military, is also a primary focus for LGBT rights supporters on the Hill.</p>
<p>Advocates are urging President Obama to include language that would overturn the law as part of his defense budget request to Congress for the next fiscal year. The request is expected to be made public early this year.</p>
<p>The Servicemembers Legal Defense Network on Tuesday published a full-page ad in Roll Call newspaper calling on Obama to include repeal in his budget request. Aubrey Sarvis, executive director of the Servicemembers Legal Defense Network, writes in the letter that Obama should include repeal in his budget request to stay true to the promise he made to end the ban last year during a speech at an HRC dinner.</p>
<p>“There is no good reason why this White House would pass up this opportunity,” Sarvis said. “It is the logical place to get rid of the discriminatory ban. We urge the president to make good on his words on the campaign trail as well as those said last October when he emphatically declared, ‘I will end Don’t Ask, Don’t Tell.’”</p>
<p>Herwitt said HRC also wants Obama to include repeal of the ban on open service as part of his defense budget request.</p>
<p>“We have been working to make that a reality,” she said. “We are hopeful and it has been part of our plan. We think that having the White House put the policy recommendations through [the] DOD [budget request] forward is important and key.”</p>
<p>Whether the budget request will, in fact, include language that would repeal “Don&#8217;t Ask, Don&#8217;t Tell” remains to be seen. Shin Inouye, a White House spokesperson, wouldn&#8217;t confirm whether administration officials would include such language in the budget request.</p>
<p>“As we are in the midst of the policy process for the FY 2011 Budget, it would be premature to comment on its contents,” he said.</p>
<p>Another bill pending in Congress is the Domestic Partnership Benefits &amp; Obligations Act. The legislation — approved late last year by both House and Senate committees — would allow the same-sex partners of LGBT federal workers to receive the same benefits as the spouses of straight workers, including health and pension benefits.</p>
<p>But the timing for a floor vote is not yet clear. Herwitt said she doesn&#8217;t know when floor votes would take place and said HRC is “working with our allies in the House and the Senate to try and figure out what is the schedule, what are they looking at.”</p>
<p>Sen. Joseph Lieberman (I-Conn.), the sponsor of the bill in that chamber, said last month a floor vote wouldn&#8217;t take place until lawmakers receive cost offset information from the U.S. Office of Personnel Management for implementing the measure within the agency&#8217;s existing budget.</p>
<p>Leslie Phillips, spokesperson for the Senate Homeland Security &amp; Governmental Affairs Committee, which has jurisdiction over the legislation, said Tuesday that lawmakers have “not yet received the offset information from OPM.” The agency didn&#8217;t respond to DC Agenda&#8217;s request for comment.</p>
