<p>Gay organizations working to end “Don’t Ask, Don’t Tell” are enjoying an open relationship with the Pentagon working group reviewing the law as they continue to express concerns about the study deviating from its purpose.</p>
<p>Defense Secretary Robert Gates and Chairman of the Joint Chiefs of Staff Adm. Michael Mullen established the working group following a Feb. 2 hearing on Capitol Hill as a way to examine how to implement an end to “Don’t Ask, Don’t Tell,” should Congress repeal the law. The work is expected to be completed Dec. 1.</p>
<p>Alex Nicholson, executive director of Servicemembers United, said his organization has had a positive engagement with the working group since its inception.</p>
<p>“They brought us in — in the very beginning — to initially brief us on what they were planning to do, to answer any questions we had,” he said. “They were very open and inclusive, but not only to us. They were that way with our opposition as well.”</p>
<p>In one such conversation, Nicholson said the working group held a conference call to answer questions about the new regulations that were instituted last month to relax the implementation of “Don’t Ask, Don’t Tell.”</p>
<p>“There was a little bit of a worry, I think, in the beginning that maybe them bringing us in, being so open in answering questions, was a one-time, token gesture,” Nicholson said. “I’m pleased to say now it’s my impression that those worries, at least so far, have been unfounded. The working group has a primary point of contact for us within the Department of Defense, and that point of contact has been extremely open and extremely available.”</p>
<p>Nicholson said Servicemembers United first spoke with someone at the working group to express concern about the group’s mandate and noted it would set a bad precedent to poll the force on potential policy changes.</p>
<p>“The working group responded to that by telling us that the terms of reference have been issued, they are what they are and they don’t have control over them,” he said.</p>
<p>In a second round of suggestions, Nicholson said Servicemembers United passed along some ideas for the methodology the working group could institute to examine how to implement repeal. Some of the recommendations, he noted, were to advise against town hall meetings and focus groups to poll the force.</p>
<p>“Focus groups are a bad idea because of the phenomena of group think and posturing,” he said. “On any perceived controversial issue, you’re going to get a much a different set of answers if you ask people about it in a group rather than asking them one on one.”</p>
<p>Aubrey Sarvis, executive director of the Servicemembers Legal Defense Network, also said his organization’s staff have had weekly conversations and meetings with the working group.</p>
<p>“I think it’s been positive, ongoing,” he said. “It’s not a process that we asked for, or that we think is needed, but we’re dealing with the reality that it’s in place and we’re going to do everything that we can to make it work and have a positive contribution.”</p>
<p>In these conversations, Sarvis said SLDN has been recommending voices and organizations that work to end the ban on open service.</p>
<p>Another organization that has engaged with the working group is the Palm Center, a think tank on gays in the military at the University of California, Santa Barbara. Nathaniel Frank, a Palm Center research fellow, said he’s had a “good relationship” with the Pentagon working group.</p>
<p>“They’ve reached out to us consistently and they’ve been responsive to us and I’m impressed by that,” he said. “The question will be, obviously, what are the results of the study and how are they expressed. So that proof will be in the pudding.”</p>
<p>Frank said the working group has asked the Palm Center to make recommendations on a litany of issues, including how to identify the costs to the military of “Don’t Ask, Don’t Tell.”</p>
<p>“That doesn’t mean just financial costs,” he said. “It means a litany of costs to morale, recruitment, cohesion, the impact on GLB service members, and Palm is coming out with a memo that I’m finalizing now that tries to convey all of those costs.”</p>
<p>Frank said the working group also asked about the pitfalls of using focus groups; how to measure the views of military families; and how to empirically assess the impact of lifting the ban on unit cohesion.</p>
<p>Another item that Frank said he was asked about was getting the views of gay service members for the study without putting them at risk for discharge under “Don’t Ask, Don’t Tell.”</p>
<p>This challenge has been repeatedly discussed in hearings on Capitol Hill and among those seeking repeal. In a statement released last week, Army Secretary John McHugh said the Pentagon is “likely” to employ a third party to solicit those views.</p>
<p>Sarvis said his understanding is the Pentagon is considering the use of a professional consultant or pollsters who have worked with the Pentagon before on manpower issues.</p>
<p>“In addition, I think they’re also looking to the RAND Corp. as part of that engagement,” he said.</p>
<p>But the decision on how the Defense Department will obtain these views is apparently not yet final. Cynthia Smith, a Pentagon spokesperson, said in a statement to DC Agenda on April 9 that the working group is still considering the best way to incorporate gay service members into the study.</p>
<p>“Getting the views of gay and lesbian service members is very important to the working group,” she said. “We are still in the process of developing the proper instrument to obtain this information from gay and lesbian service members currently serving.”</p>
<p>Frank said he would take issue with any decision from the Pentagon to use a third party to solicit the views of gay service members because it would create a situation where service members generally would speak to one group, and gay, lesbian and bisexual service members would talk to another.</p>
<p>“Uniform personnel … would be consulting service members generally and then they would employ civilians or a third party only to speak to known gays and lesbians,” he said. “There’s an unfairness there in having the military speak directly to straight service members and not to gay service members.”</p>
<p>A better solution, Frank said, would be for the Pentagon to issue new regulations that would enable all service members to speak to the working group without fear of being discharged under “Don’t Ask, Don’t Tell.”</p>
<p>“The only consistent way to do it is to apply that uniformly to all people and not have separate standards, which is obviously the problem with the policy as it is,” he said.</p>
<p>Even with the openness between these groups and Pentagon officials, some repeal advocates say they have concerns about the working group’s direction.</p>
<p>Gates has repeatedly said the purpose of the group will be to examine how to implement an end to the ban should Congress repeal the law during the Senate hearing in February. But some repeal advocates say there’s a lack of clarity.</p>
<p>Nicholson said he has “big concerns” about the direction the group is heading, recalling testimony that Jeh Johnson, head of the Pentagon’s Office of General Counsel and co-chair of the group, gave before the House in March in which the results of the working group would inform how Congress would proceed on the issue.</p>
<p>“And that, I think, was very dangerous and was a new twist,” he said. “If the mission of the working group is to simply come up with an effective implementation management plan for after repeal takes effect, then there really should be no reason why Congress should need to wait for the outcome of the working group.”</p>
<p>Frank also acknowledged “some confusion” about whether the purpose of the working group is to study how to lift the ban or whether to lift the ban.</p>
<p>“I think the reason for that confusion is while the group says it’s studying how to lift the ban, given the strategic intention of the president, whether the ban is actually lifted is in the hands of the Congress,” Frank said. “So if the group comes out with a study that exaggerates the risks to cohesion, or other risks associated with lifting the ban, obviously, that will make it easier for obstructionists in Congress to try to block repeal.”</p>
<p>Frank called on leaders handling the group to “make it more clear that they are assessing how best to lift the ban” and note that the only reason they’re evaluating repeal is to determine how to mitigate any harm.</p>
<p>“It’s important to say that years and years of research across the board make clear that that impact will be negligible or non-existent, and most of us already know that,” he said.</p>
<p>Nicholson was particularly critical of the White House and said he thinks it’s “extremely concerning” President Obama hasn’t come out and clarified the study’s purpose. Nicholson noted that he’s been asking for clarification from the White House for several weeks now and hasn’t received a response.</p>
<p>“I just felt like with the working group, they’ve been very much great in communicating with us, been very receptive, I do get the impression that they’re honestly considering the suggestions we give to them,” he said. “The White House, on the other hand, it’s felt like we’ve been throwing suggestions down a black hole.”</p>
<p>Nicholson said he doesn’t think that White House officials are seriously considering his organization’s input and that “they ignore a lot of us for weeks at a time sometimes.”</p>
<p>“Unfortunately, the White House is not only not listening to or considering our suggestions and communicating with us, but they haven’t given any indication that they intend to clarify the position of the working group or curtail the expansion of its scope,” he said.</p>
<p>Shin Inouye, a White House spokesperson, disputed the notion that the White House wasn&#8217;t engaged with the Servicemembers United.</p>
<p>&#8220;The White House is actively engaged with Servicemembers United and other groups on many issues of interest to the LGBT community, including &#8216;Don&#8217;t Ask, Don&#8217;t Tell,&#8217;&#8221; he said in a statement.</p>
<p>But Sarvis said he thinks the group will stay on track with its mission as long as it adheres to its mandate and stays focused on implementing open service.</p>
<p>“If they move away from their mandate, if they get into polling on if or whether, or seeking the personal opinions of service members, then, yes,” he said, “I think we have a problem.”</p>

<p><strong>Marine Corps leader wants separate rooms for gay troops</strong></p>
<p>   The uniform leader of the Marine Corps says he would seek separate quarters for Marines should Congress repeal “Don’t Ask, Don’t Tell.”</p>
<p>   In an interview with Military.com published March 25, Marine Corps Commandant Gen. James Conway said he wouldn’t require straight Marines to bunk with gay Marines on base, if the situation can be avoided, should Congress repeal the law.</p>
<p>   “We want to continue [two-person rooms], but I would not ask our Marines to live with someone who is homosexual if we can possibly avoid it,” Conway said. “And to me that means we have to build [bachelor enlisted quarters] and have single rooms.”</p>
<p>   Conway said the Marine Corps is the only service that has two-person rooms because the service thinks it good for unit cohesion, but should the law change allowing open service, the Marine Corps would want to have single rooms.</p>
<p>   “If we believe [two-person rooms] is going to be adverse to unit cohesion, then why wouldn’t we join every other services’ standard and say that, you know, under the previous regulations it was conducive, under the current regulations, it’s got the potential to cause friction,” he said.</p>
<p>   In the course of engaging Marines on their positions on gays in the military, Conway said an “overwhelming number” have “significant concern” about issues regarding repeal of “Don’t Ask, Don’t Tell,” although he wouldn’t estimate a percentage.</p>
<p>   “If perception is reality, we just think our corps would not want to see it changed,” Conway said. “If it is changed, it’s going to require some leadership engaging to make sure that our orders are carried out.”</p>
<p>   Pressed further by Military.com on why separate rooms are necessary, Conway said he would “want to preserve the right of a Marine that thinks he or she wouldn’t want to do that, and again, that’s the overwhelming number of people that say they wouldn’t like to do so.”</p>
<p>   Media sources during the past several months have cast Conway as one of the leading opponents of repealing “Don’t Ask, Don’t Tell” in discussions among the service chiefs.</p>
<p>   In a statement, Nathaniel Frank, senior research fellow at the Palm Center, a think-tank on gays in the military at the University of California, Santa Barbara, said Conway’s proposal doesn’t square with decades of research on gays in the military.</p>
<p>   “Decades of research, including all of the conclusions of the 1993 RAND study, shows that separating gays and straights is a bad idea,” he said. “RAND found that creating policies that are applied only to one group of people or to accommodate the prejudices of another group of people only undercut the larger mission of a unified, integrated force.”</p>
<p><strong>   Boxer introduces COBRA bill to benefit partners</strong></p>
<p>   U.S. Sen. Barbara Boxer (D-Calif.) introduced legislation last week that would allow same-sex domestic partners to have the same access to COBRA benefits as married couples in some circumstances.</p>
<p>   The bill, known as the Equal Access to COBRA Act, would allow LGBT people to continue to receive coverage for their same-sex partners under COBRA if they lose their job and their former employer offered health benefits to domestic partners.</p>
<p>   In a statement, Boxer called the issue the legislation would address “a question of fairness.”</p>
<p>   “Every family deserves access to health insurance, especially in this tough economy,” she said. “This bill ensures that domestic partners and their families will have equal access to health coverage after a job loss.”</p>
<p>   According to Boxer’s statement, more than half of Fortune 500 companies cover domestic partners under their health plans.</p>
<p>   Under COBRA, or the Consolidated Omnibus Budget Reconciliation Act, employers must continue to offer health care coverage to departing workers and their beneficiaries for up to 36 months.</p>
<p>   Joe Solmonese, president of the Human Rights Campaign, said in a statement that Boxer’s bill is important because same-sex couples “are equally affected by economic hardships and should have equal access to important benefits like COBRA continuation coverage.”</p>
<p>   “In these troubled economic times, when many Americans are concerned about the security of their jobs and health insurance, LGBT people should not also have to worry whether the COBRA safety net will be there to help protect the health of their families,” he said.</p>

<p>Experts on “Don’t Ask, Don’t Tell” are lambasting the Justice Department, claiming the administration misrepresented their views in a legal brief aimed at thwarting a court challenge to the ban on open service.</p>
<p>Nathaniel Frank, a senior fellow at the Palm Center, a think tank at the University of California, Santa Barbara, said the Obama administration mischaracterized his views on the impact that open service would have on privacy issues.</p>
<p>“The way they portrayed me is preposterous and I’m not sure that any person in good faith hearing what I had to say could conclude what the [Department of Justice] concluded in their [request for] summary judgment,” he said. “I specifically said having a concern about privacy is not irrational, but using that privacy concern as an argument for the need to ban gays is irrational.”</p>
<p>Aaron Belkin, director of the Palm Center, similarly claimed the Justice Department misrepresented what he said in depositions about privacy arguments, and even went so far as to say the Obama administration lawyers weren’t being truthful.</p>
<p>“They completely misrepresented my statement in the deposition,” Belkin said. “They were not being truthful about my statement because they said that I claimed that there is a rational basis for the privacy arguments, and I claimed no such thing.”</p>
<p>In a request for summary judgment released earlier this week, the Justice Department names Frank and Belkin as among the experts on “Don’t Ask, Don’t Tell” who gave depositions in the case of Log Cabin v. United States. The lawsuit seeks to overturn the ban on the basis that it infringes upon the First Amendment rights of LGBT service members.</p>
<p>Both Frank and Belkin were questioned during deposition about whether privacy concerns for service members constituted a rational basis for the enactment of “Don’t Ask, Don’t Tell” in 1993.</p>
<p>The brief says Frank “acknowledged” during his deposition that “privacy concerns such as those on which Congress relied were not irrational.” But Frank disputed this characterization, pointing to his remarks during deposition.</p>
<p>According to an excerpt of the deposition obtained by DC Agenda, Frank was asked about privacy issues in the context of whether former Chairman of the Joint Chiefs of Staff Gen. Colin Powell’s statement in 1993 that service members “are required to live in communal settings that force intimacy and provide little privacy” was based on professional military judgment.</p>
<p>Frank replied that Powell — whose position has since evolved to endorse the Pentagon’s process for repealing the law — may have had concerns with privacy as a general matter based on professional judgment, but said Powell’s statement doesn’t “constitute an argument for keeping out open homosexuals.”</p>
<p>“Because what he says here is that service members are required to serve with very little privacy, so it doesn&#8217;t make any sense to me to conclude from that that there is a justification to exclude open homosexuals since he&#8217;s just acknowledged that part of being in the military means sacrificing privacy,” Frank said in his deposition.</p>
<p>It’s for this reason that Frank is now saying the Justice Department misrepresented his views in the brief against the lawsuit.</p>
<p>“So I really said the opposite of what the DOJ motion claims,” he said. “I made very clear that I would not call those feelings [about privacy] irrational, but nor would I call it rational to use that feeling as a legitimate basis for excluding a whole group of people. And that’s all there in the record.”</p>
<p>Belkin similarly cried foul, claiming the Justice Department mischaracterized his deposition in the brief. The administration says that Belkin testified that “the privacy basis is rational in circumstances such as combat where private accommodations are not possible.”</p>
<p>“Dr. Belkin studied the experience of the Israeli military and found that heterosexual concern about privacy necessitated, in certain instances, separate accommodations or work arrangements for heterosexual service members,” says the brief. “Dr. Belkin also acknowledged similar findings with respect to Congress’ concern regarding sexual tension within the military.”</p>
<p>According to the brief, Belkin also “pointedly admitted” people in the military have sex with each other, and some service members have “sex with other members of the same sex.”</p>
<p>But Belkin said the Justice Department’s account of his deposition and his alleged acknowledgement of a rational basis for privacy concerns was completely off the mark.</p>
<p>“People who defend ‘Don’t Ask, Don’t Tell’ for almost 20 years have been confusing up with down and left with right,” he said. “If the Obama administration lawyers think that my remarks in any way constitute an acknowledgement of the rational basis for the privacy rationale, then they need a new legal team.”</p>
<p>Belkin said the Justice Department neglected to mention major points about his deposition. He said he brought up men having sex with other men because he believes straight men would be having sex with men in the military regardless of the ban.</p>
<p>“Think for a minute about prisons,” he said. “It’s not exactly the same, but the point is not that gays are responsible for gay sex, but a lot of people have same-sex sex in the military and the privacy rationale does not take that into account. The privacy rationale is premised on the assumption that it’s only gays who having sex, so you have to get rid of the gays if you want to get rid of that kind of thing.”</p>
<p>Belkin also said the Justice Department misconstrued his take on there being a rational basis for “Don’t Ask, Don’t Tell” because some straight service members are uncomfortable around gay service members.</p>
<p>“It’s absolutely true that some heterosexual service members are uncomfortable in front of gay service members, but that in no way constitutes a rational basis for the privacy rationale because gays and lesbians are already serving with straight service members — and the conditions in the barracks and the showers are not going to change after the repeal of the ban,” he said.</p>
<p>The Justice Department didn’t respond to a request for comment on Frank and Belkin’s assertions that they were mischaracterized in the brief.</p>
<p>Frank also took issue with the Justice Department’s repeated references to experts on “Don’t Ask, Don’t Tell” with the use of quotation marks.</p>
<p>For example, the brief says in a footnote that “LCR’s ‘experts’ ultimately seek to challenge the wisdom of the DADT policy, a challenge that is irrelevant under rational basis review.”</p>
<p>Frank said the repeated reference to experts in quotation marks is “highly unusual” for the Justice Department and “may have gone too far.”</p>
<p>“That’s a favorite tactic of the religious right to polish their anti-intellectual credentials, and make it seem like there’s no such things as a homosexual, so they’ll put homosexual in quotes,” he said.</p>
<p>The Obama administration defense of the “Don’t Ask, Don’t Tell” statute against the challenge from Log Cabin is causing consternation among advocacy groups seeking to repeal the law.</p>
<p>Joe Solmonese, president of the Human Rights Campaign, said “we took a step backward” with the Justice Department brief in the move to repeal “Don’t Ask, Don’t Tell” and that the brief “relies on arguments that were debunked and discredited in 1993, and even more so now.”</p>
<p>Solmonese also called on the administration to “show leadership, move the debate forward, and work with Congress to get repeal done” this year.</p>
<p>“While the Pentagon undertakes its review of how to implement repeal, Congress can and must move forward in repealing DADT in the same bill that put it into law more than 17 years ago — the defense authorization act,” he said. “And the president can and must provide the leadership necessary to get the law passed this year.”</p>
<p>Aubrey Sarvis, executive director of the Servicemembers Legal Defense Network, expressed similar disappointment in a statement responding to the brief.</p>
<p>“SLDN understands the Justice Department’s role in defending the constitutionality of federal laws, even ones with which its leaders do not agree,” Sarvis said. “However, there continues to be a big and unnecessary disconnect between what DOJ files in court and what the president says on Capitol Hill and to his top [Department of Defense] leadership team.”</p>
<p>Sarvis said he wants the White House to make clear to Congress that “Don’t Ask, Don’t Tell” is a priority this year for President Obama and for the president to include repeal language in budget language headed to Capitol Hill in the coming weeks.</p>
<p>“The president’s defense budget repeal language should mirror the words in his State of the Union speech to Congress and the American people,” Sarvis said.</p>
<p>In a statement, Tracy Schmaler, spokesperson for the Justice Department, said the administration is defending &#8220;Don&#8217;t Ask, Don&#8217;t Tell&#8221; as &#8220;it traditionally does when acts of Congress are challenged.&#8221;</p>
<p>&#8220;The department does not pick and choose which federal laws it will defend based on any one administration’s policy preferences,&#8221; she said.</p>
<p>Schmaler said Obama disagrees with the underlying judgments Congress used to pass &#8220;Don&#8217;t Ask, Don&#8217;t Tell,&#8221; and noted that the president &#8220;believes and has repeatedly affirmed that ['Don't Ask, Don't Tell'] is a bad policy that harms our national security and undermines our military effectiveness.&#8221;</p>
<p>&#8220;The president and his administration are working with the military leadership and Congress to repeal this discriminatory [law],&#8221; she said.</p>

<p>The uniform leader of the Marine Corps said on Thursday he would seek separate quarters for Marines should Congress repeal &#8220;Don&#8217;t Ask, Don&#8217;t Tell.&#8221;</p>
<p>In an interview with <a href="http://www.military.com/news/article/conway-concerned-with-gays-in-barracks.html?wh=wh">Military.com</a>, Marine Corps Commandant Gen. James Conway said he wouldn&#8217;t require straight Marines to bunk with gay Marines on base, if the situation can be avoided, should Congress repeal the law.</p>
<p>&#8220;We want to continue [two-person rooms], but I would not ask our Marines to live with someone who is homosexual if we can possibly avoid it,&#8221; Conway said. &#8220;And to me that means we have to build [bachelor enlisted quarters] and have single rooms.&#8221;</p>
<p>Conway said the Marine Corps is the only service that has two-person rooms because the service thinks its good for unit cohesion, but should the law change allowing open service, the Marine Corps would want to have single rooms.</p>
<p>&#8220;If we believe [two-person rooms] is going to be adverse to unit cohesion, then why wouldn&#8217;t we join every other services&#8217; standard and say that, you know, under the previous regulations it was conducive, under the current regulations, it&#8217;s got the potential to cause friction,&#8221; he said.</p>
<p>In the course of engaging Marines on their positions on gays in the military, Conway said an &#8220;overwhelming number&#8221; have &#8220;significant concern&#8221; about issues regarding repeal of &#8220;Don&#8217;t Ask, Don&#8217;t Tell,&#8221; although he said he wouldn&#8217;t estimate a percentage.</p>
<p>&#8220;If perception is reality, we just think our corps would not want to see it changed,&#8221; Conway said. &#8220;If it is changed, it&#8217;s going to require some leadership engaging to make sure that our orders are carried out.&#8221;</p>
<p>Pressed further by Military.com on why separate rooms are necessary, Conway said he would &#8220;want to preserve the right of a Marine that thinks he or she wouldn&#8217;t want to do that, and again, that&#8217;s the overwhelming number of people that say they wouldn&#8217;t like to do so.&#8221;</p>
<p>Media sources in the past several months have reported Conway has emerged as one of the leading opponents of repealing &#8220;Don&#8217;t Ask, Don&#8217;t Tell&#8221; in discussions among the service chiefs.</p>
<p>In a statement, Nathaniel Frank, senior research fellow at the Palm Center, a think-tank on gays in the military at the University of California, Santa Barbara, said Conway&#8217;s proposal doesn&#8217;t square with decades of research on gays in the military.</p>
<p>“Decades of research, including all of the conclusions of the 1993 RAND study, shows that separating gays and straights is a bad idea,” he said. &#8220;RAND found that creating policies that are applied only to one group of people or to accommodate the prejudices of another group of people only undercut the larger mission of a unified, integrated force.”</p>

<p>As the top U.S. commander overseeing operations in Iraq and Afghanistan expressed support Tuesday for reconsidering “Don’t Ask, Don’t Tell,” he noted the Pentagon study currently underway could offer a positive or negative take on open service.</p>
<p>Following his initial remarks on “Don’t Ask, Don’t Tell,” Gen. David Petraeus, commander of U.S. Central Command, made the remarks to the Senate Armed Services Committee on the possible outcome of the study.</p>
<p>Chairman Carl Levin (D-Mich.) asked Petraeus to confirm he said earlier in Levin’s office that the study could show repeal’s “likely effects could go in either direction.”</p>
<p>“I believe you told me — either negative or positive, the study could show,” Levin said.</p>
<p>Petraeus affirmed that he made those remarks, saying, “It could. It could. Yes, sir.”</p>
<p>Asked by DC Agenda to clarify this view of the study, Levin replied, “Yeah, in terms like the impact on recruitment, readiness — it could have a positive or negative — and that’s what he confirmed here.”</p>
<p>Petraeus didn’t talk to reporters after the hearing.</p>
<p>If the parameters of the study are to determine whether repeal would have a positive or negative impact — as opposed to examining the best way to implement repeal — it would be inconsistent with how Defense Secretary Robert Gates outlined the review in congressional testimony last month. At the time, Gates said the study would focus on implementing repeal and not whether it would be beneficial or harmful to the military.</p>
<p>“The question before us is not whether the military prepares to make this change, but how we best prepare for it,” he said. “We received our orders from the commander-in-chief and we are moving out accordingly.”</p>
<p>The nature of the study as described by Petraeus and Levin also raises questions about why President Obama, who campaigned on repeal of “Don’t Ask, Don’t Tell,” would authorize a review that could complicate repeal efforts.</p>
<p>But Kevin Nix, spokesperson for the Servicemembers Legal Defense Network, said he’s “confident” the working group will follow the directive outlined by Gates “to figure out how best to implement open service.”</p>
<p>“The Senate repeal bill gives the military plenty of additional time — well into 2011 — to look at how to transition while Congress moves to end the law in 2010,” Nix said.</p>
<p>Nathaniel Frank, author of “Unfriendly Fire” and research fellow for the Palm Center, a think-tank on gays in the military at the University of California, Santa Barbara, said the problem with the working group is that it could succumb to what he called “political expediency.”</p>
<p>Frank said “mounds of research” have already answered questions about the impact on open service in the military. If the group does its job well, Frank noted, the findings will be consistent with this research and discover “there will be no negative impact or that any impact will be negligible and manageable.”</p>
<p>“But if the group falls prey to political pressure to exaggerate the risks to readiness, that will be used by obstructionists to derail reform in Congress, and ultimately full repeal is up to Congress,” Frank said.</p>
<p>Although the study was outlined as a way to implement repeal, Frank said what Gates actually put in place was a “political process,” and Obama’s willingness to set it up “does raise concerns about a repeat of the failures of 1993.”</p>
<p>Whatever the focus of the study, Petraeus backed the review Tuesday during the hearing as the best way to approach “Don’t Ask, Don’t Tell” while saying the time has come to “consider a change.”</p>
<p>“I believe the time has come to consider a change to ‘Don’t Ask, Don’t Tell,’ but I think it should be done in a thoughtful and deliberative manner,” he said. “And that should include the conduct of the review that Secretary Gates had directed that would consider the views of the force by changing the policy.”</p>
<p>Petraeus initially asked for eight minutes to give a statement on “Don’t Ask, Don’t Tell” in response to a question from Sen. John McCain (R-Ariz.), but Levin denied him that opportunity, saying giving the general eight minutes would violate the rules by going over the time McCain was allotted for questioning.</p>
<p>Levin said another senator could devote their entire question-and-answer time for Petraeus so he could offer his longer statement, although no committee panel volunteered their time. At the end of the hearing, Levin said he would welcome the longer statement from Petraeus if he wanted to submit it as part of the record.</p>
<p>In response to Petraeus’ remarks, Nix said SLDN is awaiting the general’s eight-minute answer before weighing in on Petraeus’ position.</p>
<p>“We agree that open service is more than a sound byte,” Nix said. “The bottom line is our service members are professionals and they know how to bring about the change to open service.”</p>

<p>A key senator who opposes “Don’t Ask, Don’t Tell” is doubtful that sufficient support exists to repeal the law this year as he continues to push for a legislative moratorium on discharges.</p>
<p>Senate Armed Services Committee Chairman Carl Levin (D-Mich.) told reporters following a hearing Thursday he’d favor legislation to overturn “Don’t Ask, Don’t Tell” this year, but said there “will be great difficulty in succeeding in repeal.”</p>
<p>“I’m in favor of repeal, but I don’t favor going to a vote if it’s going to be a setback for those of us who think the program should be repealed,” he said. “I can take a whip check, but I think there’s a real problem … getting repeal approved.”</p>
<p>Fearing a lack of votes, Levin said he’s pushing for a legislative moratorium. The senator noted that such a measure would be “logical” because it doesn’t predetermine the outcome of the Pentagon study currently underway.</p>
<p>“Once the commander-in-chief says people shouldn’t be discharged for simply being gay, I think there’s real dilemma,” he said. “And when we think about that dilemma … hopefully, we’ll lead people to see that the moratorium is an attractive position because it doesn’t prejudge the outcome.”</p>
<p>Levin said he wants a legal opinion of the validity of a moratorium as well as what will happen with pending discharges as the Pentagon completes its review.</p>
<p>Asked whether the White House has been pushing for a moratorium as a way to address “Don’t Ask, Don’t Tell” this year, Levin replied, “Not to me. They may have in some other place.”</p>
<p>But groups opposing “Don’t Ask, Don’t Tell” are reluctant to embrace a moratorium and say there’s still an opportunity this year for repealing the law outright. In an organizational statement sent by spokesperson Trevor Thomas, the Human Rights Campaign emphasized the possibility of repeal this year.</p>
<p>“We believe the votes to repeal this failed law can be found and everyone who wants to see ‘Don’t Ask, Don’t Tell’ end needs to strenuously lobby their elected leaders,” says the statement.</p>
<p>Kevin Nix, spokesperson for the Servicemembers Legal Defense Network, was similarly bullish in a statement on passing full repeal this year.</p>
<p>“It’s too early to be talking about … half measures like a moratorium,” he said. “We’re focused squarely on getting full, permanent repeal of ['Don’t Ask, Don’t Tell'] in the defense authorization bill.”</p>
<p>Alex Nicholson, executive director of Servicemembers United, said he would support any measure that “had a realistic chance” of alleviating the burden on gay service members, but noted that he was unconvinced a moratorium would be a politically easier vote than outright repeal.</p>
<p>“We’ve heard from some offices on the Hill that they don’t see a practical difference between the two,” he said. “So if there’s going to be a vote on anything this year, we would like it to be on full repeal.”</p>
<p>Nicholson said he would much prefer a push for a vote on full repeal “with modifications” rather than “settle for an equally tough vote on a temporary moratorium.”</p>
<p>During the hearing Thursday, lawmakers pressed Navy and Marine Corps leaders on their views on “Don’t Ask, Don’t Tell.”</p>
<p>When Levin asked witnesses whether they support repeal of the 1993 law at this time, Navy Secretary Ray Mabus said he favors repeal but also supports the study advanced earlier this month by Defense Secretary Robert Gates.</p>
<p>“Since ‘Don’t Ask, Don’t Tell’ is a law, whatever happens resides in Congress,” he said. “I support the repeal of ‘Don’t Ask, Don’t Tell,’ and I think the president has come up with a very practical and workable way to do that.”</p>
<p>Chief of Naval Operations Adm. Gary Roughead and Marine Corps Commandant Gen. James Conway reiterated their support for the Pentagon’s review as they had done in congressional testimony Wednesday.</p>
<p>But Conway said he wouldn’t want any change to undermine military readiness, and noted that “Don’t Ask, Don’t Tell” is working. He advised against any change at this time.</p>
<p>“At this point, I think the current policy works,” he said. “My best military advice to this committee, to the secretary, to the president, would be to keep the law such as it is.”</p>
<p>In a statement, Servicemembers Legal Defense Network Executive Director Aubrey Sarvis rebuked Conway for his remarks, saying the commandant was having his position both ways by supporting a study geared toward ending “Don’t Ask, Don’t Tell” and opposing repeal at this time.</p>
<p>“General Conway was the only chief to say to Congress this week that the law is ‘working,’” Sarvis said. “It is not working. Having a law on the books that fires talented troops, at a time of two wars when all manpower is needed, is not effective and does not enhance the performance and readiness of the force.”</p>
<p>During the hearing, Sen. Joseph Lieberman (I-Conn.), who’s slated next week to introduce Senate repeal legislation, said he agreed with Conway that overturning “Don’t Ask, Don’t Tell” should be “held up to the standard of the military readiness.”</p>
<p>“I’m supportive of the end to ‘Don’t Ask, Don’t Tell,’” he said. “I believe it’s the fair and right thing to do, but in the end … this has to pass the test of military readiness.”</p>
<p>Lieberman said he believes repeal will pass this test based on what’s happened in other countries that have lifted their bans on open service.</p>
<p>“I hope that we will conclude repealing ‘Don’t Ask, Don’t Tell’ will enhance military readiness, but that’s yet to be determined as the study goes on,” he said.</p>
<p>The issue of what the United States can learn from foreign militaries in implementing repeal also emerged during the hearing. Roughead said the working group was necessary to examine the impact on repeal on the U.S. Navy. He said other studies on the effect of repeal on other navies that have lifted bans on open service don’t address the consequences of repeal in the United States.</p>
<p>“While I have high regard for those other forces, they are not us, they do not come from our culture, they do not come from the beliefs that young men and bring into the service,” he said.</p>
<p>Nathaniel Frank, author of “Unfriendly Fire” and research fellow at the Palm Center, has emphasized in arguments in favor of repeal how other countries have lifted bans on open service. Responding to Roughead, Frank said the United States can learn from these countries on this open service as it has on other issues.</p>
<p>“There’s no question that each culture is different, each military is different,” he said. “But the U.S. military has repeatedly looked to other militaries to study issues, including this issue, as well as housing and health and personnel management.”</p>

<p>A majority of voters continue to support allowing gays to serve openly in the U.S. military, 57-36 percent, according to a new poll.</p>
<p>   But the same findings, published Wednesday by the Quinnipiac University Polling Institute, found that voters favor restrictions on gay service members “exhibiting” their sexual orientation on the job, 54-38.</p>
<p>   The new poll is consistent with several polls in recent years showing that the American public favors repealing “Don’t Ask, Don’t Tell,” the 1993 law prohibiting gays, lesbians and bisexuals from serving openly in the U.S. military.</p>
<p>   Support for repeal was particularly strong among Democrats, who favor repeal 72-23 percent. Independents support open service 56-37 percent, while Republicans oppose repeal by 53-40 percent.</p>
<p>   Responders from military households with an active or reserve member or a veteran in their family were divided on repeal, 48-47 percent. Men narrowly favor repeal, 51-44 percent, while women support open service, 62-29 percent.</p>
<p>   Peter Brown, assistant director of the Quinnipiac University Polling Institute, said in a statement that the new findings show “American voters say go ahead and allow gays to openly serve in the military.”</p>
<p>   “But they are much more mixed on exactly how the transformation of the military will occur and how the Pentagon should adjust to needs of gay soldiers, sailors and Marines,” he said.</p>
<p>   Brown also said the poll “perhaps surprisingly” found little difference in support for repeal among different age groups. The poll found that 57 percent of people ages 18-34 favor repeal; 59 percent of people ages 35-54 favor repeal; and 54 percent of people age 55 or older favor repeal.</p>
<p>   The poll offered other findings on topics related to “Don’t Ask, Don’t Tell”:</p>
<p>   • voters said prohibiting open gays from serving in the U.S. military amounts to discrimination, 66-31 percent;</p>
<p>   • responders said the military shouldn’t pursue disciplinary action against gays who are outed by third parties, 82-10 percent;</p>
<p>   • voters said ending the law won’t be divisive in the U.S. military or impair the nation’s ability to fight effectively, 65-30 percent;</p>
<p>   • responders said the U.S. military shouldn’t provide domestic partner benefits for service members with same-sex partners, 50-43 percent;</p>
<p>   • and responders were split on whether straight service members should be required to share quarters with gay personnel, 45-46 percent.</p>
<p>   Nathaniel Frank, author of “Unfriendly Fire” and research fellow at the Palm Center, a think-tank on gays in the military at the University of California, Santa Barbara, said the findings are “a reminder of just how poorly understood [‘Don’t Ask, Don’t Tell’] is, and also of the limitations of polls.”</p>
<p>   “Respondents say highly contradictory things, including the assertion that majorities both oppose restrictions on openly gay service and believe that such openness should continue to be restricted,” he said.</p>
<p>   Frank said the notion of whether the ban on open service is discrimination isn’t “a matter of opinion but an empirical question.”</p>
<p>   “Whether banning open gays is discrimination in the first place is not open to question, and even the creators of [‘Don’t Ask, Don’t Tell’] acknowledge the policy is discriminatory,” he said.</p>
<p>   But Frank said the new findings have “some relevance to the debate” because they show continued decline in opposition to open service over time.</p>
<p>   “While polls should not be the basis of social or military policy, these trends do undercut the old ‘unit cohesion’ argument that says openly gay service will harm the bonds of trust that create cohesive units,” he said. “As tolerance of, and comfort with, homosexuality continues to rise, it becomes harder to claim with a straight face that working closely with a gay person is going to bring down the world’s most powerful fighting force.”</p>
<p>   Quinnipiac University determined the results of the survey by surveying 2,617 registered voters nationwide, Feb. 2-8. The margin of error is 1.9 percentage points.</p>

<p>Activists are ramping up efforts this year to push for repeal of “Don’t Ask, Don’t Tell” while remembering that similar optimism in 1993 on lifting the ban on gays serving openly led to the law’s creation.</p>
<p>Last week, President Obama affirmed his commitment during the State of the Union address to repealing “Don’t Ask, Don’t Tell,” noting that he’d work this year with Congress and military leaders to end the law. His announcement brought new life to the issue in the mainstream media and among activist groups.</p>
<p>But amid this activity, the shadow of what took place in 1993, when LGBT advocates had similar optimism about lifting the ban, is influencing the work that’s happening today.</p>
<p>When former President Bill Clinton took office 17 years ago, advocates expected him to fulfill his campaign pledge to end the ban preventing gays from serving in the military. Since there was no federal law on the issue at the time, the only step required to end the ban was administrative action.</p>
<p>But resistance from Congress — particularly from then-Senate Armed Services Committee Chairman Sam Nunn — and opposition from military leaders such as then-Chairman of the Joint Chiefs of Staff Gen. Colin Powell thwarted Clinton’s efforts to end the ban.</p>
<p>The result was the 1993 law that came to be known as “Don’t Ask, Don’t Tell,” which at the time was billed as a compromise because it would ostensibly allow gays to serve in the U.S. military provided they didn’t disclose their sexual orientation.</p>
<p>Many activists have said Clinton was unable to fulfill his promise to end the ban because the LGBT community didn’t provide him with sufficient political cover to accomplish his goal.</p>
<p>Clinton also holds this view. After gay activist Lane Hudson questioned him on the matter last year during the Netroots Nation conference, Clinton told an audience of bloggers that advocates in 1993 “couldn’t deliver” support in the Congress needed to administratively end the ban.</p>
<p>David Smith, vice president of programs for the Human Rights Campaign, in 1993 was communications director for the Campaign for Military Service, a group that worked to help guide Clinton’s efforts to repeal the ban. While acknowledging LGBT activists made some possible missteps at the time, Smith told DC Agenda that a number of obstacles contributed to the creation of “Don’t Ask, Don’t Tell,” not just deficiencies from activists.</p>
<p>“You had a very exuberant, politically naïve community combined with a politically naïve new president, a Democratic-controlled Congress that wasn’t all that enthusiastic about lifting the ban, and you had a Republican minority in Congress that was dying to regain the majority and inflict political harm on the new president and the Democratic Congress,” Smith said.</p>
<p>Smith said the LGBT community might have fared better if the issue had come up later in Clinton’s term as opposed to soon after he took office.</p>
<p>“In retrospect, I think if the community would have waited a year or two to better understand military resistance and understand congressional resistance, and mapped out a plan, Congress wouldn’t have been so quick to impose a law, and there might have been a different path,” Smith said.</p>
<p>Nathaniel Frank, author of “Unfriendly Fire” and research fellow at the Palm Center, a think-tank on gays in the military at the University of California, Santa Barbara, was similarly reluctant to ascribe the failure of lifting the ban in 1993 solely to shortcomings from the LGBT community.</p>
<p>“Yes, the gay community could have done more if it was bigger, more organized, better funded,” Frank said. “Political leaders need the pressure of constituents to help them get done what they need to get done, but I think that President Clinton there was really evading responsibility.”</p>
<p><strong>Learning from mistakes</strong></p>
<p>Whatever responsibility LGBT supporters had in creating “Don’t Ask, Don’t Tell,” activists this year are learning from mistakes made at that time to support Obama in his goal of repealing the law.</p>
<p>Smith said one of the lessons learned from 1993 on repeal is to make tactical decisions after thoughtful planning. He noted that his organization has been “quietly pressing for action” for months on this issue in Congress and in the administration.</p>
<p>A more public campaign, Smith said, will launch soon and target states with lawmakers who would be key to overturning “Don’t Ask, Don’t Tell.” Smith estimated the campaign would cost more than $2 million and would involve grassroots and grasstops efforts as well as earned and paid media.</p>
<p>“It’s very targeted, but again it’s still unclear exactly how this is going to unfold and it could go in any number of directions,” Smith said. “We need to be ready to deal with whatever direction it does go in to make sure the ultimate outcome is what we all expect.”</p>
<p>Smith declined to comment on which states HRC would target in its campaign or what the comment of earned and paid media, saying that such information needed to remain confidential for tactical reasons.</p>
<p>Alex Nicholson, executive director of Servicemembers United, said his organization also is ramping up efforts amid the greater push to repeal “Don’t Ask, Don’t Tell.”</p>
<p>“We always hoped it would happen sooner rather than later, but I think it’s definitely been a surprise that the president has decided to include this issue in the State of the Union and to move forward on this quickly,” Nicholson said. “So we’re obviously trying to rapidly expand our capacity, roll out a number of campaigns and initiatives that we wanted to get underway.”</p>
<p>Nicholson said Servicemembers United has been getting numerous media calls and has been identifying LGBT service members and veterans to respond to those requests. He also noted that his organization is trying to identify high-ranking retired military members who are straight and support allowing gays to serve openly.</p>
<p>Additionally, Nicholson said organizations opposed to “Don’t Ask, Don’t Tell” are having a larger number of collaborative meetings and working to “share information, share intelligence, share resources, work together more closely.”</p>
<p>But the lessons learned from 1993 are hanging over all efforts to repeal the law this year. Frank said advocates of repealing “Don’t Ask, Don’t Tell” should keep in mind the arguments that opponents of gays in the military used then in the new push for overturning the law.</p>
<p>“The first thing that gay advocates should do is understand the history of the tactics the people used the last time — the fear tactics, the delay tactics, the dishonesty, the slippery slope arguments — making this much scarier and complicated than it really is,” Frank said.</p>
<p>Frank also cautioned against underestimating the vehemence with which opponents of gays in the military will defend the status quo.</p>
<p>“The religious right has been somewhat quiet on social issues in the last year and the media have been quiet on social issues,” Frank said. “They haven’t been as big, but make no mistake, they’ll come roaring back, so it’s important not to underestimate the vehemence of homophobia and the strength of the opposition to reform in military or religious circles.”</p>
<p>Still, Frank said advocates should be ready to differentiate between those who have “genuine anxiety” about what the change means for the U.S. military and those who are expressing concern simply to block repeal.</p>
<p>While it’s unclear what opponents of repeal are planning this year, Smith said HRC is anticipating the traditional faces — such as Elaine Donnelly of the Center for Military Readiness and Tony Perkins of the Family Research Council — to “get in their TV makeup” to build opposition to repealing the law.</p>
<p><strong>Familiar arguments</strong></p>
<p>Opponents of gays in the military are starting to emerge with familiar arguments that were often used in 1993.</p>
<p>Following Obama’s State of the Union address, Sen. John McCain (R-Ariz), who’s quickly becoming the primary opponent of any “Don’t Ask, Don’t Tell” repeal in the U.S. Senate, issued a statement in support of current policy.</p>
<p>McCain noted that “we have the best trained, best equipped, and most professional force in the history of our country,” suggesting that ending the ban on gays serving openly would be detrimental to unit cohesion and take away from the U.S. military’s standing in the world.</p>
<p>Jarrod Chlapowksi, a gay U.S. Army veteran who supports HRC in its Voices of Honor tour, said “there’s a ton of ways” for supporters of repeal to approach McCain’s argument.</p>
<p>“The unit cohesion argument has been disproven numerous times,” he said. “We have the example of Israel. I don’t think anyone would say Israel has a weak military by any means, and that tends to be a pretty strong example. But there really is nothing supporting McCain’s position that this would be detrimental to unit cohesion.”</p>
<p>Another frequently used argument against allowing gays to serve in the military that could emerge again is concern about whether straight service members would be comfortable using shared shower facilities with gay troops.</p>
<p>But Chlapowksi said that concern can be allayed by noting that gay service members are already showering with straight troops and the change in policy hasn’t been shown to be disruptive in other countries.</p>
<p>“We already share showers, we already share foxholes, we already share barracks,” he said. “The only change is that you know who’s gay and who’s not. The reality is that’s not going to cause someone to go crazy and to make an exodus of troops.”</p>
<p>Even with the experience of 1993 looming over activists, much has changed in 17 years. Recent polls consistently show that a majority of the public supports repeal, and have even found that a majority of conservatives favor allowing gays to serve openly.</p>
<p>Smith said opponents of gays of military could thus have the issue backfire on them if they handle it incorrectly.</p>
<p>“The country is facing economic hardship, two wars — and if Republicans spend a lot of time trying to create political animosity around this issue, it could backfire on them big time,” Smith said. “But our opposition is not to be underestimated.”</p>
