D.C. court disputes claim by trans group over why LGBTQ crime victim housing facility was closed

Court never promised specific number of residents for ETC apartments: agreement

A spokesperson for the D.C. Superior Court released a statement to the Washington Blade on Jan. 11 disputing claims by the local organization Empowering the Transgender Community, known as ETC, that it was forced to suspend operation of its temporary emergency housing facility for LGBTQ victims of violent crime because the court reneged on a promise to send enough residents to financially sustain the facility.

ETC announced in March of 2022 that it had entered into a Memorandum of Understanding with the D.C. courtā€™s Crime Victims Compensation Program to provide temporary emergency housing specifically for LGBTQ crime victims for up to 30 days through an arrangement with the courts.

Earline Budd, ETCā€™s executive director, said ETC had rented a small apartment building to operate a housing facility that she said last March could accommodate up to 26 individuals or a smaller group of families for the crime victims program. Court officials have since said the number was reduced to 22 because a few of the apartments in the building would be used for ETC staff offices.

The location of the facility had to remain confidential, Budd said, as part of the agreement with the courts to ensure the safety of its residents.

But in December Budd informed the Blade that ETC had to suspend its operation of the housing facility in November because the court did not provide enough tenants to financially sustain the facility. Budd said the director of the Crime Victims Compensation Program, Blanche Reese, told her and others during a visit to the ETC facility last March that the program expected to fill the facility to its capacity with crime victim residents.

Budd said the far fewer than expected residents sent to the ETC facility by the court created a financial shortfall when the overhead costs of renting the building and paying staff to operate the program exceeded the reimbursement payments they received from the court.

ā€œThe court never promised ETC a specific number of claimants to be housed by this provider,ā€ said Douglas Buchanan, director of Media and Public Relations for the D.C. Courts, in a statement to the Blade.

Buchanan pointed to the four-page Memorandum of Understanding between ETC and the courts, which Buchanan sent to the Blade. The document, which was signed by Budd on Feb. 15 2022, makes no mention of the number of ā€œvictim/claimantsā€ the court would send to the ETC facility.

The MOU states that the reimbursement by the Crime Victims Compensation Program (CVCP) to ETC ā€œfor each emergency housing stay is limited to a period of 30 days at the rate of $100.00 per day.ā€

The MOU states that CVCP would reimburse ETC for the costs of food if food is provided to the victim/claimants. ā€œThe amount shall not exceed $100.00 per week up to a total of $400.00,ā€ the MOU says.

Buchanan also provided the Blade with comments from Crime Victims Compensation Program Director Blanche Reese, regarding Buddā€™s claim that Reese made a verbal promise to send enough tenants to fill the ETC facility to capacity.

ā€œThe managers were told that the facility would probably stay full because the facility was so beautiful and some of the other facilities were not as nice,ā€ Reese said. ā€œMy statement was taken out of context,ā€ Reese added. ā€œThey were also informed of how placement is decided. For example, if a crime happened in S.E. (where the facility is located) we would try to place the claimant away from the crime location, unless the claimant signed a disclaimer.ā€

According to Reese, ā€œUltimately, the claimant makes the decision if they want to stay at the facility that CVCP suggestsā€¦ETC was never promised a specific number of claimants. They were told that it would vary.ā€

Budd said ETCā€™s financial problems were heightened when the court program failed to send its reimbursement payments on time, sometimes sending them a month or two after they were due.

In his statement to the Blade, Buchanan said the delays in reimbursement payments were caused by ETC submitting inaccurate invoices. The MOU calls for ETC to provide invoices related to the claimants who stayed at the ETC facility.

ā€œIn the beginning, the delay in payments were due to inaccurate invoices submitted by ETC,ā€ Buchanan said. ā€œThe CVCP director and accounting officer had a meeting with the [ETC] board to explain the process and clear up any discrepancies,ā€ he said. ā€œIt was at that time the ETC board authorized the CVCP to correct any inaccurate invoices submitted and process the payments to address the delay in processing payments.ā€

In response to concerns raised by ETC that the court also didnā€™t fully reimburse ETC for the cost of food for crime victims and their family members sent to the facility, Buchanan said ETC was aware of restrictions by ā€œfood capsā€ set by the CVCP rules

In her statement sent to the Blade by Buchanan, Reese said the court ā€œhad no idea that ETC relied on the CVCP as their sole source of funding.ā€ Reese said she was contacted by the attorney representing the ETC organization asking for a meeting with her to discuss the groupā€™s finances.

ā€œIt was at this meeting that they informed me that the ETC board had made a decision to temporarily cease providing housing because of accounting issues,ā€ Reese said. ā€œAt this meeting we also discussed staffing concerns because I was informed that the entire staff had resigned,ā€ said Reese. ā€œWe were supposed to revisit the viability of the ETC organization in January 2023.ā€

Budd has said staffing issues surfaced when the lower reimbursement of funds from the court due to fewer residents than expected caused a shortfall in funds preventing ETC from paying some of its staff and paying the rent for the building.

She said ETC remained hopeful that it could reopen the emergency housing facility for the crime victims program if its arrangement with the court could be revised. She said ETC was also in discussion with the D.C. Department of Human Services over the possibility that the ETC facility could be used as a low-barrier shelter for homeless people.

Budd said that due to the privacy restrictions required for the crime victims program, she didnā€™t think the ETC building could be used for both crime victim residents and homeless residents at the same time.

But in his statement to the Blade, Buchanan said, ā€œThe decision to use the facility for other purposes would totally be up to the ETC executive director and board.ā€

Buchanan said the court would also like to revisit its relationship with ETC, although he said the ETC attorney or ETC board members had not contacted the CVCP about resuming the program as of earlier this week.

ā€œWe are looking forward to ironing some things out and we are optimistic that the courts and ETC are going to get together in the coming months in an effort to try to hammer out some of these issues and try to pave a path forward that benefits those that ETC and the DC Courts serve,ā€ he said.

Budd and the ETC attorney, Charles Ross, couldnā€™t immediately be reached to get their reaction to the statements sent to the Blade this week from Buchanan and CVCP Director Blanche Reese.

Buchanan sent a copy of an email that attorney Ross sent to Buchanan this week in which Ross said he would not be responding to the Bladeā€™s request for comment at  this time.

200 turn out for ā€™Love Festā€™ Drag Story Hour at Freddieā€™s

Between 200 and 250 people, including parents and their children, turned out on Saturday, May 4, for a ā€œLove Festā€ Drag Story Hour brunch hosted by the Arlington, Va., LGBTQ establishment Freddieā€™s Beach Bar and Restaurant.

Local drag performer Tara Hoot, who read childrenā€™s stories and handed out coloring books to the kids attending the event, was joined by members of the Gay Menā€™s Chorus of Washington, which sang several songs before Hoot began reading from childrenā€™s books in keeping with the tradition of drag queens conducting Drag Story Hour events across the country.

The May 4 event at Freddieā€™s in the Crystal City section of Arlington took place four weeks after the start of a similar event hosted by Freddieā€™s was delayed by a bomb threat, forcing those who had arrived  to exit through a rear door and wait in a parking lot as Arlington police conducted a search of the premises with a bomb sniffing dog. No trace of a bomb was found.

All the customers, including parents and their kids, were invited back inside and the show took place as planned.

No similar threat occurred at the May 4 event. But three male protesters assembled on the sidewalk next to the parking lot behind the Freddieā€™s building, with one of them shouting from a bullhorn passages from his Bible that he said indicated the Drag Story Hour event was an ā€œabomination.ā€

The three protesters were outnumbered by nearly a dozen counter protesters who were  members of the Rainbow Defense Coalition, an LGBTQ organization. They carried bright, rainbow-colored umbrellas while chanting messages of support for the Drag Story Hour event.

Freddie Lutz, Freddieā€™s Beach Bar owner, called the event a ā€œsmashing successā€ that brought an ā€œoutpouring of love from the community.ā€ Lutz released a flier on social media promoting the Love Fest event shortly after the earlier event interrupted by the bomb threat as a showing of love “to stop the hate.”

“Join us for the next story time brunch dressed in your favorite rainbow/hippie outfit” and “carry your favorite homemade signs of support,” Lutz said in his promotional flier. He came to the event dressed in what he called his hippie protest outfit.

Lutz said while the protesters did not interrupt the event, he was concerned that their shouting was scaring some of the kids as they and their parents walked by the protesters to enter Freddieā€™s.

ā€œI went out back and tried to talk to one of them and it was kind of like talking to a brick wall,ā€ Lutz told the Washington Blade. ā€œHe was screaming at the parents that were crossing their kids on the crosswalk,ā€ Lutz said. ā€œAnd I said, youā€™re screaming at those kids, youā€™re scaring them.ā€

Lutz said the man told him he was yelling at the parents, not the kids. ā€œAnd I said, no youā€™re not. The kids are hearing you. Youā€™re scaring them.ā€

Added Lutz, ā€œAnd to have such a fun-loving, happy show and then walk out on the sidewalk to that is very disheartening. Itā€™s really sad. I told him my God is a forgiving and loving God.ā€

One of the protesters, who declined to disclose his name, said he and his two fellow protesters came to talk about the gospel of Jesus Christ. 

ā€œWe want them to know this is an abomination to the Lord,ā€ he told the Blade. ā€œWe want them to know those children donā€™t have a voice and theyā€™re being brainwashed in there. Weā€™re here to call out their sin.ā€

Stephanie Krenrich, who brought her two-year-old daughter to the event, said she strongly disputes the claims of the protesters.

ā€œI brought my daughter here because I think that it was a beautiful and wonderful show, and it was great for her,ā€ she said. ā€œAnd I think itā€™s pretty offensive when people come to Arlington and tell parents what to do, especially for something so beautiful and so fun and so wholesome,ā€ she told the Blade.

ā€œSo thatā€™s why I brought her,ā€ Krenrich said. ā€œI think that itā€™s really important that we stand up for our values and people just being themselves, being happy and being them.ā€

Among those who attended the event were four elected officials from Arlington ā€“ Virginia State Sen. Barbara Favola, Virginia State Del. Adele McClure, Arlington County Board member Maureen Coffee, and Arlington and Falls Church Stateā€™s Attorney Parisa Dehgani-Tafti.

Also attending was Nick Benton, editor and publisher of the LGBTQ supportive Falls Church, Va., News Press; and Kellen McBeth, president of the LGBTQ group Equality Arlington.

ā€œIt was fantastic to see so many people come out to support Freddieā€™s, to support the LGBTQ+ community,ā€ McBeth said. ā€œIt was a great event and weā€™re happy to be a part of it.ā€

Another successful Taste of Point fundraiser

Scholars praise financial, networking support

The Point Foundation hosted its annual Taste of Point DC fundraising event on Thursday with nine participating restaurants, a drag performance, and a silent auction. 

The event was hosted on the rooftop of the Room & Board on 14th Street, with an afterparty at Shakers. Point donors, scholars, and alumni circled the rooftop eating chips and guacamole from Mi Vida and drinking Pinot Grigio from Barkada. 

After about an hour of mingling the events began with event committee member, Kelly Horton and Kevin Kim Wright, chief of staff welcoming the crowd and speaking about the importance of their presence during this pivotal time in queer youth history. Then, Wright welcomed BIPOC Scholar Katherine Guerrero Rivera, saying she was a model of a Point scholar. 

ā€œWeā€™re always impressed with all of our scholars and Katherine is another example of a student who is deeply engaged in their campus life and a myriad of projects, everything from creating her own podcast to being a part of a number of student organizations.ā€ Wright said. 

Rivera said that the Point Foundation scholarship helps her resist the pressure to drop out. She pointed out that just over 50 percent of Latina students who attend college graduate. 

ā€œThe Point BIPOC Scholarship is not just financial support, Point has connected me with hundreds of people like me studying on campuses across the country.ā€ she said.

Rivera is a criminology major and poetics minor at University of Maryland and said she hopes to use her degree to bring knowledge to her community through art and advocacy. She said it is important for her to take academic jargon and make it accessible to her community. 

ā€œToo often, the history of LGBTQ and people are ignored and silenced during our education,ā€ she said. ā€œI want to use my access to higher education and the chance to develop my creative skills to bring light to societal issues.ā€

She finished her speech with applause for the audience, then Horton came back with drag queen Tara Hoot to discuss ways donors could continue to support the Point Foundation. 

After the lineup of events Wright said he felt great about the event, because it was a celebration of Pointā€™s scholars. 

ā€œSome are interning for United States senators, some are volunteering for leading national non-profits, so to be able to celebrate all thatā€™s being done here is truly amazing,ā€

Wright continued, thanking the D.C. restaurant community for consistently showing up in force to support Point. 

ā€œThis really helps to paint the picture that this movement is growing,ā€ he said. ā€œPeople believe in this mission to provide LGBTQ young people with the opportunity to pursue their higher education goals, to improve their leadership abilities and then go on to make a significant impact on society.ā€

D.C. Council member proposes change for Mayorā€™s Office of LGBTQ Affairs

Parker also seeks increased funding for LGBTQ programs in FY 2025 budget

D.C. Council member Zachary Parker (D-Ward 5), the Councilā€™s only LGBTQ member, has asked his fellow Council members to support a proposal to change the Mayorā€™s Office of LGBTQ Affairs to become a ā€œstand-alone entity outside the Executive Office of the Mayor to allow for greater transparency and accountability that reflects its evolution over the years.ā€

In an April 30 letter to each of his 12 fellow Council members, Parker said he plans to introduce an amendment to the cityā€™s Fiscal Year 2025 Budget Support Act to make this change for the LGBTQ Affairs Office.

His letter also calls for adding to the cityā€™s FY 2025 budget two specific funding proposals that local LGBTQ activists submitted to D.C. Mayor Muriel Bowser that the mayor did not include in her budget proposal submitted to the Council. One calls for $1.5 million to fund the completion of the build out and renovation for the D.C. Center for the LGBTQ Communityā€™s new building in the cityā€™s Shaw neighborhood and $300,000 in subsequent years to support the LGBTQ Centerā€™s operations.

Parkerā€™s second budget proposal calls for what he said was about $450,000 to fund 20 additional dedicated LGBTQ housing vouchers as part of the cityā€™s existing program to provide emergency housing support for LGBTQ residents and other residents facing homelessness.

ā€œThe Office of LGBTQ+ Affairs currently manages about 90 vouchers across various programs and needs,ā€ Parker said in his letter to fellow Council members. ā€œAdding an additional 20 vouchers will cost roughly $450,000,ā€ he wrote, adding that dedicated vouchers “play a crucial role in ensuring LGBTQ+ residents of the District can navigate the complex process of securing housing placements.ā€

In her proposed FY ā€™25 budget, Bowser calls for a 7.6 percent increase in funding for the Office of LGBTQ Affairs, which amounts to an increase of $132,000, bringing the officeā€™s total funding to $1.7 million.

ā€œTo be clear, I support the strong work and current leadership of the Office of LGBTQ+ Affairs,ā€ Parker says in his letter to fellow Council members. ā€œThis push for change is in recognition of the officeā€™s notable achievements and the significant demands being placed on it, which require a greater level of accountability.ā€

Parker told the Blade in an April 30 telephone interview that he believes Japer Bowles, the current director of the Office of L|GBTQ Affairs is doing an excellent job in operating the office, but he believes the office would be able to do more for the LGBTQ community under the change he is proposing.

ā€œMaking it a stand-alone office versus it being clustered within the Community Affairs division of the mayorā€™s office, it will get more attention,ā€ Parker told the Blade. ā€œThe leadership will have greater flexibility to advocate for the interest of LGBTQ residents, And we will be able to conduct greater oversight of the office,ā€ he said, referring to the Councilā€™s oversight process.

Parker noted that other community constituent offices in the mayorā€™s office, including the Office of Latino Affairs and the Office of Veterans Affairs are stand-alone offices that he hopes to bring about for the LGBTQ Affairs Office. He said Council member Brianne Nadeau, who chairs the Council committee that has oversight for the LGBTQ Affairs Office, has expressed support for his proposal.

Also expressing support for Parkerā€™s proposal to make the LGBTQ Affairs Office a stand-alone office is the D.C. Advisory Neighborhood Commission Rainbow Caucus. Vincent Slatt, the caucusā€™s chairperson, submitted testimony last week before the D.C. Council Committee on Public Works and Operations, which is chaired by Nadeau, calling for making the LGBTQ Affairs Office a stand-alone office outside the Executive Office of the Mayor.

Slatt also stated in his testimony that the office has a ā€œchronic staffing shortageā€ and recommended that at least three additional staff members be assigned to the office.

Daniel Gleick, the mayorā€™s press secretary, told the Blade the mayorā€™s office is reviewing Parkerā€™s budget proposals, including the proposed change for the Office of LGBTQ Affairs.

But in testimony at a May 1, D.C. Council budget hearing before the Councilā€™s Committee on Executive Administration and Labor, Lindsey Parker, Mayor Bowserā€™s Chief of Staff, appeared to express skepticism over making the LGBTQ Affairs office a stand-alone office. Lindsey Parker expressed her thoughts on the proposed change when asked about it by Councilmember Anita Bonds (D-At-Large), who chairs the committee that held the hearing.

ā€œI would proffer that it doesnā€™t matter whether the agency is within the EOM [Executive Office of the Mayor] or not,ā€ Lindsey Parker told Bonds. ā€œThey will still be reporting up into one would argue the most important agency in the D.C. government, which is the one that supports the mayor,ā€ Lindsey Parker said. ā€œSo, itā€™s the closest to the mayor that you can get,ā€ she said ā€œSo, you could pull it out and have a different budget chapter. I actually think thatā€™s confusing and convoluted.ā€

Lindsey Parker added, ā€œThe Mayorā€™s Office of LGBTQ Affairs, with their six FTEs right now, if they were a stand-alone function they wouldnā€™t have all the non-personnel services in order to operate. They need to be under sort of the shop of the EOM in order to get those resources.ā€Ā
