Federal appeals court expected to issue Prop 8 appeal decision

A federal appeals court in San Francisco is expected to announce on Tuesday whether it will hear an appeal of a February ruling that struck down California’s voter-approved ban on marriage for same-sex couples.

Proposition 8 supporters requested that the U.S. Ninth Circuit Court of Appeals allow an 11-judge panel to reconsider the case “en banc” after a three-judge panel found that the Golden State’s ban on nuptials for gays and lesbians unconstitutional. Their ruling upheld now retired U.S. District Court Judge Vaughn Walker’s Aug. 2010 decision that struck down Prop 8.
