Feds advise on trans school policy

NEW YORK — A 34-page memo released Monday from the Department of Education said transgender students in public schools should be enrolled in single-sex classes that align with how they present, Time reports.

The memo says federal law protects students’ gender identity.

“Under Title IX,” it reads, a school “must treat transgender students consistent with their gender identity in all aspects of the planning, implementation, enrollment, operation and evaluation of single-sex classes.”

While previous resolution agreements between school districts and the education department have articulated a similar stance, advocates hope the new guidance will clarify the rights of transgender students across the U.S.

Investigations into school districts’ treatment of transgender students have already set a precedent that they are protected under Title IX, which prohibits gender-based discrimination.
